    Sure, if you have a registered patent on it.

    I suppose you could. If you produce a registered patent that was granted before they were produced, you are going to be a very rich person. If you can not produce evidence, you will be out a couple in court costs.

    Yes, but since that hole has been patented by others, you have no case.
