Does a cheating spouse get awarded alimony?

If a couple were to get divorced and the one who would normally get alimony was caught cheating with irrefutable evidence, would they still be awarded alimony?

    nobody is awarded alimony nowadays and nobody cares who cheated on whom. too many Hollywood movies u have been watching

    That's an odd question. I'm guessing it comes from outside of the United States. Thanks to the feminist movement, women wanted equality...and for the most part, they got it. In most states, there is no such thing as alimony anymore. There is no such thing as fault-based divorce, either.

    There are some exceptions. SOME states you can file on fault grounds and SOME states still allow for alimony to be awarded, under certain circumstances.

    But seeing as your odds of getting alimony under any circumstances are about 1% or lower to begin with, and there was irrefutable evidence of cheating...

    I wouldn't expect the cheating spouse to even think about asking for alimony, if that was even allowed...

    It depends on the laws where you live.

    In Canada we have "no-fault divorce". And MOST U.S. States have this now too.

    This means the Courts don't care who did what .. there are set laws and they are followed.

    This also means there is no alimony.

    This also means that the ONLY property/money that gets divided is "marital assets" .. meaning only whatever either person acquired DURING the marriage (inheritances are not considered marital property). And the marital assets are split 50/50.

    The Courts consider both spouses to be legal adults, and upon divorce, neither is responsible for supporting the other (alimony).

    You are thinking of the way divorce USED to be handled. Certainly, don't take your legal "knowledge" from tv shows, not even the court-room shows.

    But check with the laws in your area. There is a bit of variation.

    In the case of a prenup and adultery clause no. In general yes the alimony would still have to be paid out many places no fault divorce.
