Should you sue someone is small claims court who have felonies on his record?
I am planning to sue someone in small claims court for damages to my vehicle during accident with him. The defendant didn't have insurance and was driving on suspended license. The accident was clearly his fault. I am afraid the guy might try to harm me if he loses his case. Is it worth going after him in court?

Why are you sueing anybody when you presumably have an insurance company? That's their job and I side with other folks who are also wondering the same thing.

Surely your own insurance will sue.
Fact is even if you have no legal cover on your insurance and sue regardless of if you win, you still need to collect, the court doesn't collect it as well, so if he doesn't pay then you would have to return to court to 'try' to get the money and pay for bailiffs to collect

It depends. Does this guy actually have any money that is publicly recorded?
He already knows how to work the system, and even if you got a judgement in your favor, that doesn't guarantee you would ever collect. You could always report him if he threatened you, but independent of that, suing him may not be worth your while.

Yes. You can't predict the future of what will happen if you win your case, but I can if you never sue to make a claim. Much like the lottery … you can't win if you don't play.

You should claim damages under YOUR insurance policy. they, in turn, will seek
reimbursement from him

Probably not as you sound like quite a meek timid type who the guy would sense and then try to intimidate in court and perhaps our of court. And I'm guessing your fears would allow him to take advantage without any recourse.

Talk to YOUR insurance guy. Your insurance guy is supposed to cover you. Then your insurance guy decides whether to go after the at-fault driver.
