What happens when your spouse dies and has debt in California?

I'm engaged to someone who is terminally ill. The odds of us actually getting married are slim but could change if he gets a transplant. He has not been evicted due to covid, but owes back rent. As well as medical bills from what his insurance won't cover. At what point would I be liable for any debts he incurs prior to marriage? If at all.

You have no liability as long as you are not married. After you are married you will take on shared responsibility for debt that took place after the marriage but shouldn't be liable for any debt that was accrued prior to being married.

He's not your spouse?  You have no legal obligation to pay ANY of his debts.

You are his fiance?  You have no legal obligation to pay ANY of his debts.

You are his spouse?  In SOME States you have a legal obligation to pay some of his debts.

    WHERE?

My story - my late husband and I were engaged, he suffered an unexpected massive heart attack at an early age, we got married in the hospital ICU (hospital had never before had a wedding in the ICU), we were told he wouldn't live 90 days.  He fooled them all, lived for over 5 years.  I would do things exactly the same all over again.  I was NOT responsible for his medical bills/debts, because that is the law in my State.  I would take advantage of the time "he" has left.

You do not owe any of his debts prior to marriage.

You are not liable, but EVERYTHING he owns is liable, including everything you and he own jointly.

It gets passed to you. If the bills aren't paid, the bill collections have the right to collect according to the contract.

The surviving spouse is responsible for the debt.

You incur his debt as soon as you get married.
