Could a gun shop use this method to get around a mandated waiting period?

Say that a State has a mandated 7 day waiting period to buy a handgun.

Well the gun shop could let the customer take the gun right then and there, but when they fill out the paperwork with the customer, they just back date the paperwork.

Just date it for 7 days prior.

Then if anyone asks, it will look like the person came and filled out the forms a week ago, and came back today to pay for the gun and pick it up.

On paper, it looks like the law was followed.

Could this work?

    The better question is "why would you want to bypass the waiting period?"

     No, it won't work. Part of the paperwork includes a background check, which would need to be done with a phone call or on the internet. Both those methods would show the actual date and time.

    We wouldn't want a mass shooter to have to wait for a background check. 🙄

    That would be breaking the law, not "getting around" the law.

    And what happens when the shopkeep proposes this to a buyer who turns out to be an undercover ATF agent?

    Not to mention a State that requires a waiting period will most likely also require a background check which includes running the persons info through the system.

    There's no way to fake the date the background check was conducted

    I would wager that is illegal, and most gun shops wouldn't take the risk to get you a gun early. And perhaps private sales are a way around the waiting period.
