Is it legal to not claim Retirement Savings Contributions Credit (Savers Credit)?

Filing taxes and only have savers credit of $50 but to claim it on TurboTax would cost $60+, otherwise I can file for free. I read on one of their forums that it is legal to not claim by saying you are a full-time student. 

Is this true even if I am 23 and not a student?

    Don't lie about being a student. Just fill out the forms someplace that doesn't charge.

    If you cannot free file the return due to the Savers Credit, print out the necessary forms from the IRS website and paper file.  You will get your Savers Credit, and it will cost zero.

    Look at one of the other free-file sites before you decide. There is a list of them on the IRS website. You are never required to claim a credit. Do not put down that you are a student when you are not.
