Medicaid laws concerning transferring property to a disabled child.?
My brother and I attended a seminar on what choices are available for Medicaid for the elderly. We learned that property can be transferred to a DISABLED child that is living in the home without penalties being applied. Our mother is 82 and bedridden, my brother is 63, disabled, has lived with her for over a year now taking care of her the best he can. However we need to have someone come in part time for a few hours (maybe 2 times a week) to help her with bathing, cook and clean a little, be a companion for a couple of hours while my brother does errands, goes to his own doctor appointments, shops for groceries, go to a movie, visits with friends, etc. I cannot help because I live too far away to go any more often than the 1 time a week I go now. We have transferred her home and car into his name. Our problem is what about her Life Insurance, CDs and US Savings Bonds? She has no savings account, she has an income (from Social Security, Pension, Widow of Veteran who served in war) of about 2200 a month. We know we have to document payments to my brother for her rent, food, medicine, care, etc. in order for her to qualify for Medicaid in order to get care for her from an outside agency that Medicaid would pay for. A quote from a elder law attorney website states "Transfers made to disabled children do not cause any penalty." But does that include the Life Insurance, CDs and Bonds? I would ask the attorney but we have already seen him and he wants $7,000 to do all the paperwork and we do not have that kind of money. Any advise you have would be appreciated. By the way, we want her to stay in her home because we feel she would be happier there and because we promised never to put her in a home (the one our grandmother was in was horrible according to her) but also if she were to go into a nursing home my brother would not be able to keep her home because all he gets if $850 a month from disability and that won't pay for all the expenses of keeping up a home. FYI we live in Missouri.

About 6 or 7 years ago my husbands mistress (don't get me started) asked my husband to go to the store to pick up some items. He gets in the car and the mistress 15 or 16 year old daughter (at that time, she is now 22) comes out and gives him some money and tells him her mom wants some vodka. My husband goes to the store, gets the items, returns to her house, puts the items on the table and leaves the room. The daughter and her friend (same age) take the vodka to the friends house where they proceed to get so drunk that the friend gets alcohol poisoning and has to go to the hospital (she is ok now). I don't know what the girls told the friends mother about where the vodka came from.
Now my husband wants to get away from the psycho b@^*^$ mistress and she is telling him that if he leaves her she will tell the mother of the girl with alcohol poisoning that he knowingly bought the vodka for the girls. As far as I know it is one persons word against the other but still it is disconcerting. If there are any real attorneys (this happened in Johnson County Kansas and we live in Jackson County Missouri) I would be most grateful for some advice and for any other person who wants to comment, please we have been through enough, I don't need to hear that I should leave him, or that's what he deserves or anything else, thank you very much.

Turned the spigot for hot water and nothing came out (tried this on all faucets, tubs and showers) but plenty of force and water coming out of the cold water side and all toilets flush. Went to the basement and the hot water heater looks ok but even if the burners were off for the water heater wouldn't I get water through the pipes? Any idea what is going on before I call a plumber? Thanks for your help.

I am one year post lap band surgery (12-17-08) and gall bladder surgery (12-31-08) but within the last 3 months I am having gall bladder symptoms (pain in neck/throat area, mid trunk and back). Does anyone have any idea of what is going on, my dr. doesn't seem to have a clue.

My mother (81) has dementia. We (my brother and I) took her to the ER from her home because it really got bad for her. She went in on a Monday afternoon, at 11pm that night they told us she was being admitted, she didn't get into a room until 1am Tuesday morning. She was in the hospital Tuesday & Wednesday and Thursday morning the social worker at the hospital said she could be released to a nursing home for further care and so she was. Then Friday about 3pm at the nursing home the director pulled me into his office and said he had received a phone call from the hospital social worker and that the social worker apologized for making the mistake of releasing Mother too early to be eligible for Medicare coverage in the nursing home. The rules for Medicare coverage are that you have to be admitted as an INPATIENT for 3 nights but Mother was classified as being admitted to her room as OBSERVE on Monday night so she was only in for 2 nights as an INPATIENT.
Now my brother and I are not trained to know this stuff like the social worker and the nursing home personnel are and we don't feel that we should pay for the mistake THEY made and the nursing home agreed because they are not charging for the 1 day she was in before the mistake was found but since the call came in so late in the day Friday I had to wait until the following Monday to contact the hospital to get information about the problem and then I didn't get an answer from the hospital until late Monday and couldn't return their call until Tuesday. SO I don't feel as if we should be responsible for the nursing home bill from Friday to Monday because it was the hospitals mistake and they were unavailable to talk to until Monday.
BTW - I already talked to the hospital and they, of course, blew me off.

I had LB last Dec. 17, Gall Bladder out Dec. 31 no problems since then but now I have GB symptoms (throat pain, sternum and back pain). My dr. took out 3cc of fluid from my band on Oct. 24 (because I had a cold he thought it might be a mucus plug blocking things from going down) and it helped immediately but for the last 2 days I have GB pain again and I don't know why (the cold is gone).
Any thoughts or suggestions?

At my local oil change place they put out coupons for 5w30 oil and they tell me my car (and my husbands and my daughters cars) all take 10w30 which, of course, there are no coupons and is $10 to $15 more than the sale price. Is there that much of a difference in the oil and if I did want to change to the 5w30 would it affect my car (especially if not all the 10w30 was removed before the new oil was put in). Thank you for your help. BTW we have a 1993 Prizm, a 1997 Contour and a 1999 Malibu.

My husband just told me he is thinking about living with his mistress of 10 years. They have both told me that they haven't had sex in months and he says she is just tied to him emotionally. She does have some sort of effect on men, I've seen it but I don't know what it is. She is a drug addict, smokes, sits around all day with her dog on the couch and listens to music or watches tv or sleeps (it is a wonder she hasn't burned down her house with all the cigs. she has dropped), she is mean to her kids (her oldest one doesn't even talk to her, neither does her mother who used to live with her). I'm just so surprised because things have been going so well with us and he gets so upset with her when he's on the phone here with her. Just last night he said he still loves me, couldn't be without me, that we have been together so long (21 years)that we are a part of each other in the way no one ever has been before. I hate the way I'm feeling now, kind of numb and in a stupor. I don't know what to do. HELP!!!! I've put up with this because I really don't care for sex too much anymore (don't worry we still "do it" 2-3 times a week) but I hate the way it takes him away from our time together and with our daughter (she is 19)

She believes that whatever she thinks will come true. If she drinks from a particular cup then she will die, if she wears a certain shirt than she will be in a car wreck, if she watches a TV show than her boyfriend will break up with her, If she eats a potato chip than our house will burn to the ground. I know she needs professional help but I don't know if it is a regular psychiatrist or is there another type of professional that handles this particular disease. Thanks for your help

Engine light is on all the time but I have had the car diagnosed and they couldn't find anything. The emergency break light stays on when the break is released and eventually will go off but will come back on after a little while, then go off again and so on. Any one have any suggestions?
