Dh adopting my son?

My dh wants to adopt my 14yr son. Is father is not on the birth cert or pay child support. My son's father has not had any contact for 10yrs! Do I have to get my son's father's permission for my dh to adopt him?

My son is all for it! He wanted my husband to adopt him 4yrs ago. We wanted to wait till he was truely old enough to understand what it ment.

I would contact the Clerk of the Superior Court and ask what the steps are. In most states if you file a petition in this court, and ask the court to terminate your son's fathers rights they will do so given what you have told us. Any man can be a father, but a real man, no a good man who knows how to love and share makes for a good daddy. Sounds to me like your new husband is that sort of man. I think it's great your husband wants to adopt your son. I don't know what the laws are, but I think it's only fair to at least try to get his biological father's permission. However, if there's been no contact for 10 years and he doesn't pay child support, then it seems like he gave up his rights a long time ago. How does your son feel about this? It depends on the laws of the state you live in. Some states require that you at least make an attempt to contact the bio father.

If the bio fathers name is not on the b/c then just do it! If he fights it he will have to prove paternity + pay for child support and such...it's not likely since he hasn't been around in 10+ years!

I adopted my now ex-husband's son. Yes, you have to get him to sign over his rights or if you think he's an unfit parent, get his parental rights terminated in court. Then your husband can adopt your son.
