People are not in or out of the public domain. You can use real people in a story, although living ones can sue you if they think you've defamed them or invaded their privacy.
Stuff that people create (stories, pictures, films, songs and so on) can be in or out of the public domain. In most countries, a person's creations fall into the public domain (and so are free for anyone to use) 70 years after their death.
