consequences for dropping rape charges?
for personal reasons, a friend of mine who was raped by her boyfriend wants to drop charges against him. she doesn't want to get back with him but due to other issues, she wishes to drop charges.
will the state continue the charges against him and if so, can she prevent that?
also, she has children, could she lose custody of them.....the father of her girls is not the rapist....
this all happened in DE

i personally don't want her to drop the charges but she is adamant...i think she is receiving some type of threat but won't really say what. she thinks she will lose her kids if she drops charges..some one from dss told her that. Anyway, as I am her friend, i want her to be fully aware of what the consequences will and could be of her actions....and moving is out of the question, she had a good job and great network of friends for childcare and stuff....

After reading your entire question, I can't help but wonder if the reason your friend is wanting to drop charges is solely because of her concern of losing custody of her children! This is an absolutely absurd consideration!
Having investigated countless rapes in the past 35 years of law enforcement, I've learned one thing....these thugs who prey upon the victims only HOPE the charges will be dropped so that they can continue their despicable violence upon others instead of going straight to jail!
If you are a true friend to this victim, you should do everything in your power to support her efforts of bringing this thug to justice!
There are countless support groups available to victims of this nature which one can obtain this information through the District Attorneys Crime Victim Office.

Whoa, it really is two different thoughts! in a unmarried tale, a guy is falsely accused of rape and then the lady receives charged with filing pretend costs. in the different tale, a rapist receives off because the lady comes to a decision she would not pick to testify in courtroom--this isn't uncommon as rape victims are traumatized and they don't pick to get grilled in courtroom and performance their sexual historic past investigated and puzzled because they emotionally can't take care of it. So which tale do you pick to inform?

Tell her to move out of the state with her kids. Then the charges will be dropped all on there own.

She may be able to drop charges it depends on the prosecuting attorney. She should not be able to lose her kids over this at all.

I believe that without the primary witness they will not pursue charges. Especially if it's a "date rape" situation that is very very hard to prove.

I don't know why she'd lose custody over her children... that doesn't even begin to make sense. Secondly, it's not your place to seek advice for her. If she wants to know more about a legal issue, she needs to speak to the police and a lawyer, not the general public.
