Help! Stranded in FL after a car accident!?
I was staying at a hotel in Orlando and an employee hit my car. As a result my car is undrivable. I'm staying with my boyfriend and it's at a repair shop so that's all ok, and we did file a police report and do all the things your supposed to. So here's my questions (when I research these for myself all I find are personal injury lawyer ads): Who is liable for the accident? The employee, the hotel owner (who assured us that everything would be taken care of) or the property owner (Amerisuites inc)? Are they liable for anything beyond the damage to the car (I'm going to need a plane ticket home and one to get back when my car is done being repaired) What if the repair is more than the value of my car? I can't afford to get a whole new car as a result. Any help you guys could offer would be extremely appreciated.

If the employee was working at the time, both the employee and the hotel are responsible for the damages, but the employee is at fault for the accident.
They owe you for the repairs to your vehicle, Loss of Use (by way of a rental), and the actual cash value of your vehicle in the event the car is a total loss. That's all they owe. They are under no legal obligation to compensate you for a plane ticket home...you can't leave your car in FL. You have to mitigate your damage.
File a claim with your insurance company, have them handle all the repairs, etc. and they'll pursue the appropriate insurance company on your behalf.

The person that hit your veh is at fault, unless they were in a company car, or on company time. Then it may be the hotels fault. But most likely the person that hit your veh. I would file the claim with there insurance company, tell them you need a rental veh. HERTZ rental company offers veh's that you can drive from state to state for no charge. I doubt there gonna pay for a plane ticket home, and back. All there liable for is to put you, and the veh back into the position you were in before the accident.

The person who hit you. Unless he was driving a company vehicle, then it lies with the hotel. Either way they will provide a rental replacement. But if you have to leave before the car is repaired they are not responsible for paying your way back to get it.

I'd say the ones that said they'd take care of everything for you. Should include a rental, till your car is repaired.
