What case can I file to a company that refuses to refund my money?
I paid this company and got a receipt. The service that I paid for was not delivered. They kept saying that they will refund me but it's now September and I paid them last June. It's been 3 months now. I follow-up every week. Need help, what case can I file against this company?
If you should know, the amount is $640. Thanks.

Without specifics, I'd guess it qualifies for small claims court. You don't necessarily have to file a claim, just threaten one. That, and reporting the company to the local better business bureau, or even a local news program (which often has someone on this sort of beat). Just make sure that you are getting higher in the company when you talk to them, be friendly, and talk about how you're only looking to get a refund for undelivered services and if they can't satisfy you, you'll have to turn to those alternative routes.

The claim is for money had and received. The form of complaint is "Defendant owes plaintiff $6 40 for money had and received on the X day of M month, 200x, which in equity defendant must refund to plaintiff, with interest from the x day, no part of which has been paid despite due demand therefor."
Good luck, he's a deadbeat and he has probably reincorporated by now.

I gotta be honest. We charge like $1000 to $1500 just to retain. You will probably spend more in attorney fees than they will give you. It is a civil case, so most likely law enforcement won't get envolved unless it turns up to be fraud. Taking money under false pretenses or something like that. Talk to local law enforcement and ask about a criminal charge. If it is only civil, you will have to get a lawyer and so on. Good luck

You should try to reverse the charges, if you paid by credit card your credit card company might be able to help you... otherwise your only option is small claims court.
if you made payment through the mail you can file a complaint with the postal inspector as well.

you should have accepted the delivery and then sent it back UNOPENED. That is how its usually done. Most cart websites do have something (usually in small print) that says "once you click buy you cannot change your mind".

small claims court and the better business bureau. You can contact the B.B.B. through their website, just type B.B.B. in your search engine.
