Difficulty getting final paycheck from unethical boss- lost check -(yeah, right)?

I worked 3 years for a boss I knew to be hot-tempered & often unprincipled. I left--she promised to mail my check. Two weeks later I inquired and was told "Oh it was mailed the same day, let me investigate."

Finally she says she'll write another one, knowing that I wouldn't cash the first one if it showed up unexpectedly (and I certainly wouldn't) Since, I've shown up, emailed, gone again today only to learn that she HASN'T even written the replacement check and her guru friend/accountant says she should put a stop payment on the first check (costing $25) and deduct it from MY check....I hung up, and then I start thinking, "What the f...? WHY should I pay that $25? A friend says, that's the cost of doing business, it's HER decision to stop-payment--not a fee I should have to share. I think I should refuse the partial check but what's my next step? Her shadiness is more offensive than her trying to carve $25 out of a $190 paycheck. Any suggestions?

    Contact the bureau of employment for your state. She can not deduct the fee, and they can file a case for you and arrange for the payment at no cost to you. Also, contact them before cashing the lesser check to ensure you are not accepting the final payment "as is" by cashing the check.

    Call your state department of labor and tell them your former boss is refusing to pay you. Ask if they can send a letter or investigate.

    If she insists on the "fee", then you need to insist (in writing) that you receive proof that the original check was written and mailed.

    take the check from her and cash it. then call the department of labor in your state and file a complaint. you may have to go to the dept of labor office. i had a boss that stopped payment on my final check. it took almost a year to get it but it's your money not theirs. this will also lead to investigations of their accounts if they are doing other shady business it should come out.
