Probation Violation?

Long story short.........my neice was placed on supervised probation for 2 years for misdeamenor check charge. she went faithfully every month and was paying on her restitution. She gave boyfriend the money to go finish paying off her fines and he said he did then told her they said since she paid the fine she was off probation......she believed him now she found out after they broke up a year later he never paid the fine and she wasn't let off probation so chances are there is a warrant for her arrest, she is scared and so are we she is a good kid, has a job and a single mom. How can we get this resolved we dont want her in jail.

Often in situations like this (in my area, anyway), when the probation warrant is issued, a cash bond is set in the amount of the unpaid restitution...

She can call her PO and ask if there is a warrant for her arrest, and if so, what the bond is... If it's a cash bond, she can surrender herself on the warrant, immediately post bond, and be released... She can discuss her options with the PO and then go from there... Her PO may be able to give her more options specific to her situation...

She could also retain an attorney, but if restitution was the only issue on the probation violation, once that restitution is paid in full, she'll probably be done with the whole deal... An attorney may cost her more than it would to just finish paying the restitution...

call the DA and explain...chances are she's out the money but will be able to pick up where she left off with probation and restitution
