Expired candy is not a basis for a lawsuit unless you became very ill from it and had to be admitted to the hospital or had to pay a Dr to treat you because of the candy. If this is not the case and you did not suffer any damages then I would not sue.

Not sue, call or write the candy manufacturer to let them know you purchased expired candy from a store. I have had this happen and simply called the company who made the candy. They were more than happy to replace it with a another bag of candy. If you do sue a company they will just pass the cost onto the consumer; you and I.

    God

This is the problem with the US. Everybody is looking to sue. Really.......How much pain and suffering did you go through because your candy was a little stale???

Take it back if you didn't finish it for a new candy bar and check the exp date BEFORE you buy next time

Thats happened to me before.... if you ate the whole thing and got sick i would sure just for medical bills ( if i had to go to the hospital....) if i ate a little and noticed it was expired i would just go back in and tell the manager... somethimes it happens that they forget candy hasd experation dates and gthey will check all there candies and fix the mistake.... if you ate it all and nothing happned then no......

in my case i noticed the candy was a little hard and read the expiration and i told the manager... he didn't even realize there were expiration dates and he started to take them all off the shelf.....

When did you purchase the product? Had it reached the expiration date before or after you bought it?

Did you see the expiration date before you ate the product?

    What damage did you suffer?

I think a law suit over this is absolutely asinine.

If you truly got sick that is another matter.

no I would not sue unless I ended up in the hospital and in a near death experience. if it was just expired and nothing happened to me then no it would be a wast of my time going to court to get a dollar from them

I am filing a suit against McDonalds because I get my lunc and dinner there EVERYDAY and it seems that I am getting FAT. I think they are giving me regular soda instead of diet with my supersized double quarter ponder meal........jerks!!!!
