Birth Certificate Help~?
Here is the situation :
A friend of mine is due in June. She got pregnant by a guy then gets dumps and marries someone else. She is still pregnant with her Ex's baby. He wants nothing to do with it and the her husband would like to sign the birth certificate of the baby.
Her husband (not the father of the baby) wants to raise the baby as his own.
Can he sign the birth certificate as the father? Does she have to list the real father? Does she have to leave it blank? What is the rule for that?
She lives in Washington State if that helps.

I'm in the UK and over here its illegal unless they legally adopt them.

In most states the husband can sign the birth certificate as if he were the father. Unless there has been a DNA test done in a court case relating to this pregnancy the state assumes that the child was born to those in the marriage, so it is fine for him to sign the birth certificate. Later on though, if they should get divorced he could always protest due to it not being his, request a DNA test and get out of all responsibility for the child. Not that this is likely to happen, but it is a possibility. The only way around it is to have the biological father sign adoption papers which will make the husband entirely responsible for the child legally and that state can then reissue a birth certificate reflecting this.

Yes he can do that...actually he's EXPECTED to do that unless the biological dad signs something.
I have in my hands a Mother's Worksheet For Child's Birth Certificate. This is what doctors and midwives have the new mom fill out. I'll quote it.
"7. Father's Current Legal Name- If the mother was unmarried throughout her pregnancy, a father may only be named if an affidavit acknowledging paternity is signed.''
This is the part that answers your question
''If the mother was married at any time during the pregnancy the name of her husband (husband is underlined) must be entered as the father unless her husband signs an affadavit denying paternity and the natural father signs an affidavit acknowledging paternity."

You got some really great answers. In the US any husband can sign the birth certificate, and this other guy would have to pay humongous legal fees to undo that and get his name on there. Have your husband sign. It is perfectly legal.

I went through this drama my self, I left my daughters father and my husband signd her b.c. Its kinda weired, the same way you have a baby you can give it anything for a last name who would of thought.
Ppl may say she has a right to know who his or her father is, I disagree somethings are better left unspoken.
Regardless of what she choses to do she is blessed to have a man love her child. Also she shouldent ever speak of the biological father not wanting the child.

I believe he can sign the birth certificate.
I mean, some men sign them not knowing they arn't the real father ya know. I don't believe you have to prove anything, just tell them who the father is(her husband) and he'll sign.

He can sign the birth certificate but it means if they break up then he will be the one responsible for child support payments

He can sign it. If they're married I don't think anyone will even question it.
