bill collectors?

I disputed a charge with a company through my credit card , they did their investigation and I got a letter stating the dispute was resolved in my favor. That was in January 2008, now June the original company has a bill collector after me, do they have a case? The original debt was from June 2007.

    Did you dispute a charge that you did not make? or on a charge that you changed your mind about?

    If you did not make the purchase and the CC Co verfied this, then the orginal creditor has no case, all they can do is sell the debt to some junk debt collector to recoup some of their loss. The collection agency has to verify that the debt is yours.

    If you simply did not want the merchandise and did not return it, then you are obligated to pay for it.

    Your best bet is to follow the FDCPA and send a letter (certified/return receipt requested) advisng the bill collector that you are requesting they validate the debt. Here is a sample letter to send (you fill in the blanks).

    Subj: Verification of Debt, request for

    This letter is to inform you that pursuant to Title VIII, Debt Collection Practices, § 809 of the Federal Trade Commission and 15 U.S.C. § 1692g, I am hereby registering a formal request for Verification of Debt.

    The account in question listed as an installment account with (NAME OF ORIGINAL CREDITOR) opened (insert date) and indicates an initial balance of (enter amount) It is now currently being shown as collection account with past due amount of (enter amount) as of (insert date).

    Unless legal proof and verification can be shown, I request you remove the derogatory entry with any credit reporting agencies that may list this debt (and any other agencies you have filed with) immediately to avoid any possible legal recourse on my behalf pursuant to 15 U.S.C.§ 1692k.

    I used to be a "bill collector". Most likely it is a mis-communication between the original company and the collection agency. You should contact the original company and again dispute the claim. You should also check your credit report and you can do this for free at www.annualcreditreport.com. You can check this for free once a year and check all three of the major credit bureaus.

    If it is on your credit report you can also dispute this with the credit bureau.

    I dont know what the charge is, but if it is not on your credit report then I wouldnt worry about it. Next time they call, tell them to cease any further communication with you. (I strongly suggest you put this in writing- certified mail) If they continue, you can sue them. Check out the Fair Debt Collections Practices Act - this will spell out your rights. Debt Collectors can not harrass, etc.

    The original company is disputing the findings of your credit card company. What Visa says really doesn't mean much in their world.

    You will have to fight the original debtor all over again. The research that Visa (Or whomever) has will be a great starting point.

    It looks like they might have sold the debt while in dispute which is illegal.

    Have all your paperwork together showing the fact that the issue was resolved in your favor.

    Call the credit reporting bureaus and discuss this with them.

    Yea and no, I was in a similar position, the amount was reversed but they charges me court fees, overdue fees ect. They wanted we to pay around $200. I paid it not to effect my credit rating. You can defend yourself and wait for them to take you to court. If it is a small just pay it not to effect you rating then close the account. The best way to get back at these companies ids through word of mouth. In the long run you will be supprised how soon they will lose business. Take foe example godaddy.com, i deal with them constantly, Whenever i have had a problem they have been helpful. If they were not helpful and took me for a ride i would be inclined to tell people not to deal with them.

    u need to notify the collector that this bill was resolved and fax then the letter u have stating its done.
