I was just fired from a Job and wanted to know if it was just and if my rights were violated?
I worked part-time at a pizza restaurant. I've only been there for 2 weeks and the reason that I was terminated is because I told the manager that there was no way I could come to work on the 4th and 5th of July because my parents own a family business and they are attending and out of town wedding (6 hours away). He said that I was expected to work holidays and since my name was on the schedule I have to honor that. I requested the day off 2 weeks ago but he didn’t honor it. I told him I can't do that again because I have another obligation and he fired me and called me a d-bag amongst other things n front of all the other employees. While I am not bitter about it, it being a part time job and all, I was just wondering if this was a rightful termination. I want to get a little revenge because I don't appreciate being called a d-bag in front of everyone. How can I fight this? Can someone please help me out? Thanks a million guys!
I suppose I should clarify something. I use to work here there as a manager for a while when I was in my teens. Then one day I was in the store and he offered me a job because he was in dire need of help. I told him that's fine but on the day I was hired I listed out the days that I couldn't work because I actually have another job and frankly the ball was in my court. Or so I thought lol. The bad thing for me and doing something about the way that the situation was handled is that it is a provately owned Domino's and the owner won't do anything to that manager.

Your boss had the right to schedule your shift for you. If you refuse to work, he can fire you for insubordination. In fact, he could fire you for almost any reason, as long as it is not a discriminatory firing.
You have no contract; you work part time; you are an at-will hiree.
If you want to get revenge, work for the competing pizza place.
Get over it, and move on; you'll meet plenty of a$$holes in your life, and they will get their's in the end.

Well! you have nothing to stop you now right! But, let me see if I got you straight? 2 weeks ago, you requested to have the 4th and 5th off?------ was it THEN you said "there was no way I could come to work on those two days etcetc-----? Maybe you should take getting fired as a lesson learned! I hope you can take this constructive advice from me, but, in the Adult world, a person just doesn't go to the boss and DEMAND a day off!! You ask nicely! Otherwise look forward to getting fired again at your next job!! If the man called you a D-bag, HE was out of line, but there is not much you can do about it! If he had actually touched you, like grabbing your arm or pushing you, THEN he is trouble, but I very much doubt he did that! Just swallow your pride, put it down to experience, and try to be a little more tactful in the future! Everybody has to learn lessons throughout your life, and this is one of them! Dry your tears and anger, it's not the end of the world! Have a great 4th of July weekend and a safe one!!!

I am an employer.
One of the things I cannot stand is spending hours interviewing someone, getting references, background checks, doing new-hire paperwork, orientation, and training, and then find out the new employee has a "vacation" or has to be away from work on the next holiday.
I would have let you go as well. I almost every state, there is a standard 90 day probationary period during which the company can let you go for almost any reason. If you are living in an "at-will" employment state you are even more out-of-luck.
Let's cut to the chase. You mis-stated your availability to work the job. That's lying on the application. You were let go with just cause.
End of line.

I don't believe that there is anything you can do. Normally for the first 30 days (some are even longer) you are considered to be on probation. During your probation period you can be fired without a reason. Not being able to work your posted schedule is grounds for termination, UNLESS you have it in writing that they agreed to give you those days off, WHEN they hired you. The other bad thing is this: Even if you had been working for the company for a year and they fired you, you probably still could not do anything about it. Most states now have a 'right to work' law which allows employer's to terminate employee's without having to give a reason.
As far as the name calling, I don't know if it is worth trying to do anything about. First you have to have witnesses and I can't imagine your ex-co-workers would be willing to speak up and possibly lose their jobs.

No the guy was an idiot to say the least . You could have booked off sick but you were honest and that speaks well for your character. To get revenge and they say Revenge is sweet! I would find out who is in charge of the franchise that the pizza place is part of and I would explain just what you have written here and tell them what this manager said to you. That is totally unacceptable to treat employees like that. If it is a private restaurant then find out who the owner is and call them or write to them and explain very nicey what happened and what he said to you. That manager should either lose his job for that or be disciplined for that. No one should employ him and he should be reported. I personally think you were treated unfairly and you should be compensated with at least a few coupons for pizza at the very least. Just take it as a lesson as to how to NOT treat employees at your family's business. ( I think the guy was jealous of you and that you had options in your life and he didn't , he was only a manager and would probably be that forever) Consider yourself lucky to get away from the creep.

you started 2 weeks prior ,and you already wanted the 2nd most popular US holiday (behind new years eve) for activities off ? your boss was right your a dirtbag, and Id have fired you too..if youd called in sick to get it off,you'd still be fired,most places you cant miss any shifts during the first 90 days PERIOD. Besides who needs an employee that thinks his other activities are more important than work on a busy weekend,they can find another pizza boy in 2 seconds why put up with one that cant get his priorities straight and hasnt grown up yet? you might want to just live off mom and dad a while longer as you arent mature enough for the real world yet.

Depends on the state.
Some states are "at will" employment states... your boss does not need a reason to fire you.
Even in the other states, it is pretty likely that he was within his rights to fire you. You refused to come to work at the time you were scheduled to. Depending on the state there may be exceptions for things like medical emergencies or sick kids...but we aren't talking about a single mom who's kid's in the E.R. here. I don't think "Mom and Dad are going out of town" would qualify for such an exception.
If your family runs a buisness you understand that SOMEBODY has to work the 4th of July weekend...and how he is not requred to honor YOUR scheduling REQUESTS....(especially as you are the new guy).
So sorry....I think you are SOL.

Part of the definition of what constitutes a Statutory Employee defines 30 full days employment. You say, 2-weeks, part-time.
Just let it go. After all, this was a d-bag McJob. Plenty of other d-bag McJobs out there.
Really, I feel for you. Everyone has been shafted on at least one job.

who cares if your parents have a business. you were working for a pizza restaurant. maybe too many people had already asked for the day off. people who had been there longer than 1 minute when they asked for the day off. so, if you have only worked there 2 weeks and asked for the day off 2 weeks before, then that means you asked for it off THE DAY YOU GOT HIRED!!! get a life. move on. you have no leg to stand on. maybe mommy and daddy should hire you.

Type up the account of what happened (your explanation here was very eloquent and showed maturity) and submit it to a superior. Hopefully it is a national chain but if not at least give it to the owner. Explain as you did here that you are not protesting the firing as much as the UNPROFESSIONAL manner in which you were treated.
You must be a great person! I am really impressed with your maturity.
