Is posting a video of street performers singing a copyrighted song considered infringement under the DMCA?

I uploaded a short video clip (taken with a digital camera) of street performers singing a song by Van Morrison. The clip was less than a minute in length and was taken on a public street in Germany. It sat on YouTube for over a year, then was removed when Morrison's record label claimed copyright infringement. Where they in the right?

    Probably, yes, they were.

    The street performers were violating his copyright by performing it, unless they were paying a fee to one of the licensing bodies.

    Whether they were violating his copyright or not, you did by posting the video, unless your posting included commentary etc in a sufficient amount that you could claim a "fair use" exemption for the publication.
