Ok me and my ex has a house together what will happen to it?
He passed away with no will.I have one son with him that is 13 and he has two grown children that are 25 and 27.He never(not even once) paid child support.The house is in both my name and his.His children dont want to see the house sold because his daughter wants to live in it(its paid for)Its in NC I live in Sc.WIll the house have to be sold or what she says she will fight for it not to be sold but that she will not buy my half out but instead she wants me to sign our(mine and my sons part) over and if she ever sells the house she will then give him half of what it sells for.My problem is shes not very mature and sometimes makes stupid choices.What if there is no half if I do that and my son gets screwed over again.This would help us alot.Hes 13 Ive raised him on my own.This could be our better future where they have had a free ride for a long time.Am I being selfish?
I dont want the house I think it should be sold.I helped buy this house but its been paid for for years.She thinks she should get it but isnt that her not takin my son into consideration either.Or am I just being selfish?
I believe I should get my half which is mine I paid for actually over half of the house (he didnt work for a long time) and then I believe their fathers side should be split between his 3 children.She feels like I should just sign it over so that she can get a loan and fix up the house and move in.What if she dont pay the loan and Cody just loses out?He has for 13 years is that fair?

You are half owner, if they go to court to lay claim to their father's portion, the court will rule the sale of the property.
There is nothing that she can do to prevent the sale without refinancing and buying you out.
BTW: She can not force you to sign it over and buy you out later. She has to buy you out before she takes possession.

No, you're not selfish. If the house is paid for, then there should not be a problem making a written contract with the daughter with certain conditions made to include a buy-out provision, and selling considerations for a share of the procedings. You two will have to come up with a fair share agreement in either case. A realtor may be able to give you some guidance.
