HELP: Questions about filing unemployment...?

I am a TN residence and have worked in both TN and NY in the past year. I was fired from a job at the end of August (had worked there 3.5 months) and picked up some part time freelance once in between. Both were in NY. Can I still file for unemployment? If so, does it have to be in TN or NY?

This really sucks.... Help?

Thanks, there. But I am still in NY looking for work. There is nothing in my field in my hometown.

    You probably have to file in New York because that's where you've most recently worked.

    To make sure, though, you should go ahead and make an appointment with the unemployment office in your location in Tennessee, talk to a counselor, and tell them what your situation is. Then they'll be able to figure out what you need to do.

    Free advice (based on experience): If you end up having to do unemployment through New York, make SURE all your ducks are in a row where your case is concerned. An interstate unemployment case (where you live in one state and end up having to file with another) provides a prime opportunity for the state that has your case to screw you over.

    EDIT - thanks for adding more details. I was thinking you were living in Tennessee.

    Since you're in New York, it's a bit simpler: New York is where you live and where you last worked, so that's where you file. The only question is whether you have enough work hours in New York to be eligible to collect unemployment benefits in NY. For that reason (as I answered before), it would still be a good idea to make an appointment at the U.E. office to meet with someone in person, explain your situation, and find out what your options are.

    If you don't have enough work hours to be eligible to collect in New York, then you'll have to file with Tennessee instead. If that's the case, then my free advice and heads-up about interstate unemployment cases still applies, albeit with the states reversed from where I first thought they would be.

    you can file TN and they can do an out of state claim to get your NY wages. However you were FIRED and unless you got a good reason to be fired you will not get any from either state. A good way to get over on that is tell them your employer was wanting you to do stuff unsafe or illegal or out of your job description.

    hmmm... in Philadelphia i think you have to work for 6 months (if your job got laid out) then you could filed for unemployment
