Do conservatives grasp the concept of cognitive dissonance?

The conservatives hail the Supreme Courts recent ruling for the New Haven fire fighters as a blow against "reverse discrimination." An overblown, more mythical than real term, but we'll leave that for another day. Fair enough.

Now, to highlight that Sotomayor was on the panel that followed the previous precedent, in an effort to highlight their efforts to paint her as a prejudiced radical of some sort, they bring in the lead plaintiff, Ricci, to testify about what it feels like to be unfairly discriminated against when other who are less qualified, based on the test taken, are put ahead of those who did better.

How did Ricci get his start in firefighting? He failed the firefighters' test, and then sued under the Americans with Disabilities Act because he said he was unfairly excluded because of his learning disability.

That's right. He failed his first test, claimed victim status and sued to get himself put in ahead of those who scored better than him on the test. And now he's going to testify about what an affront it is to justice and common sense for those who do worse on the test to get in ahead of those who did better.

Fox News and conservatives will dutifully follow their talking points and paint him as a champion of meritocracy. Feel free to explain to me how this makes sense. Isn't this why the GOP is flailing for relevancy?

Warren - your facts are wrong. She has not had 8 cases overturned. She's had six cases reviewed, four overturned. That's wrong in 66% of the cases they deemed worth looking at. 98.5% of the opinions she has authored were good enough to not even merit a hearing. That makes her right, by Supreme Court reconing, 99% of the time, not wrong 80%.

Super_B - I'm not talking about Sotomayor's ruling on the case, or what she considered. I'm talking about the argument the GOP is making, and the person they choose to hold up as an example of their argument. I've never claimed that this had ANY bearing on her ruling on the case. Your entire answer is completely unrelated to the question.

Warren - also, Alito had two cases reviewed, and two overturned. By your measure, he's always wrong.

    Since when do facts matter to Fox News? I'm sure they will spin Ricci's story to suit their own radical-right agenda regardless of the facts. They know most of their viewers will swallow the pill whole and without skepticism. Fox News, on several occasions when damaging news stories have broken, reported that the offending [person] was a member of the Democrat party when, in fact, they were a Republican.

    One such case in point: South Carolina Gov, Mark Sanford's recent adultery scandal. Another example: Rep. Mark Foley (a Republican) was reported by Fox News to be a Democrat while Fox News was reporting on the scandal surrounding allegations that he engaged in sexually explicit electronic communications with underage former congressional pages.

    To be fair, Fox News isn't the only one to be trigger happy when it comes to erroneously accusing a bad seed to be a Democrat. Fox just does it more often and isn't known for correcting their errors publicly. Read more about it here: http://mediamatters.org/research/200610130010

    Wait... are you trying to say that minorities are at a mental disadvantage and that's why the exams should have been thrown out? That's not very nice.

    I could potentially see the value of a case involved testing and learning disabilities. For example, a dyslexic person might take longer to complete a test than the test normally allows for. It might not make them any less capable at doing their job, but at a disadvantage while taking a test. It /could/ make sense for some situations that a learning disability unfairly excludes someone from competing on an exam. I don't know what his specific claim was or any of the details. I'm just saying it could make sense and be a valid claim.

    However, race doesn't have any such impact. So how is the attempt to throw out test results because not enough minorities passed it at all similar to the other case?

    the problem with your firefighter story is that since this lady is going to try and become supreme justice material she needs to look at her cases as if nothing else ever happened in the world. just because a fireman cheated the system earlier does not mean that his claim at the moment becomes invalid. plus he was not the only person to get discriminated against. there were 12 people who jointly filed a complaint.

    and the whole reverse racism is a wrong choice of words. it is just plain racism and it happens every day, every time a minority with no education gets hired over someone who has skills and experience just because of their skin or some quota needs to be filled. that is the problem. because there were not enough blacks ( quota) that scored high enough these men missed out on promotions or pay raises when they themselves scored high enough to get them. that is the discrimination. if those blacks had scored higher then they would have gotten raises.

    so when looking at his case we are not trying to see what kind of person eh is but weither there is discrimination at this point in time. the case has nothing to do with him personally. you should stop trying to throw out his case because you don't like the guy.

    I find it offensive how you are trying to link conservatives to those Republican pieces of scum. The GOP doesn't represent real conservatives anymore than the Democrats would.

    Both of those parties blow, don't link the rest of us to them.

    what you fail to say is that all 9 justices said there was no legal set precedent for the lower court to argue. all of them! she has been over turned 8 of 10 times.so 8 out of ten she got it wrong.not just ricci.

    Alan Spectar said, paraphrasing, "I have 'no comments' on your testimony, but your record is exemplary".

    He couldn't find one word of approval in her testimony?
