I was awarded property in a divorce settlement, only to find out that my husband quit-claimed it already?

He quit-claimed the property that was awarded me to his ex-wife. Now what?

    It really depends on what state you are in. If you are in Kansas, for instance, he could be in some serious trouble! Even if he quit-claimed the property to someone else it wasn't his to do that with until the divorce settlement was final. I would call my lawyer if I were you. I think your ex-hubby just pooped on his own plate!

    Well, you have to go back to court, but I would contact an attorney and also sue for the cost of the attorney and the value of the property or the property put in your name. Say you had planned to hold onto the property for years to give it time to increase in value and so forth. He will now be in contempt of court as it wasn't his property to give it or sale it to someone else. Does he really think that he will just get away with this? Either way, hire an attorney and don't forget to sue for the cost of it, as it shouldn't have been necessary for you to have to hire one to get the property that was already awarded to you. What you can also do is contact whoever holds the deed/claims and ask them what you can do and fax/mail them copies of the documents you have. You may just be able to get them to correct this.

    So if my children was awarded and there is a quit-claim deed in set. Now my ex has passed and will all assets to my son and his half sister. His half sister is not entitled to the house that was awarded in my divorce settlement to my children? We live in the state of Illinois

    Who did he quit claim it too?

    If your state is a community property state he can't do it without your signature.

    These states are community property states.

    * Arizona

    * California

    * Idaho

    * Louisiana

    * Nevada

    * New Mexico

    * Texas

    * Washington

    * Wisconsin

    Regardless, it would be worth your while to do a consultation with an attorney. Might be free or low cost for the first visit.

    Inform your attorney and get him back in front of the judge that granted your divorce to explain his actions. He knew these were awarded to you, and he signed a document (or there was a judges decree) which awarded these to you. He will now be responsible with GIVING you the cash value of these items.

    Talk to him about it. Ask him all of the details about it. Basically, have the conversation recorded. Finally, call a lawyer and be sure to provide all of the information your husband has given you whether it is true or untrue. Keep in mind that the truth will get you what is due to you and the lies will make him look bad.

    If the ownership of the property was court ordered then he is committing fraud. You should contact your attorney immeditely and head back to court to settle this. He and the ex have something up their sleeve.

    Get off your fanny and get a hold of your attorney,and tell him or her you need an exparte order as soon as possible!!! Do not wait..
