Did my mother kidnap my brother?
My mother left the country a few months ago on a supposed vacation to visit her sisters in the US and she took my brother along with her. After the 1st month my father receives divorce papers and of course he freaks out since she said that she no intention of ever coming back and shes taking my brother with her. So isn't that technically kidnapping since both parents have to agree over who will have custody of the child?
Also whats gonna be done in this situation since obviously the police here in Japan can't arrest her while shes in the US.

File a report. Japan could work with the US to get a warrent out for her arrest and have her exterdicted to Japan.

Yes it is kidnapping and you should file a report and that way US can be notified and find your mom.
