Can you fight a Handicap Parking Ticket ?
Got a ticket in an apartment complex for parking in a handicap spot when I wasn't really in the spot I was 1/4 in the area Next to the spot and the rest of my car on grass . Handicap spot was wide open and more then 1/2 of the "load" area box was open. But still got the ticket same as parking in the spot. The handicap spot is also wider then required @ 15ft plus 3 ft extra load area... I don't think the ticket should be the same as if i blocked the spot all together.. I was wrong for even having the 1/4 of my car in the spot but should ticket be a full $250 charge??? APartment complex has major shortage of parking (32 to 20) and Now every night someone has gotten the same ticket. Cops making his quota here for sure,,,I have NEVER gotten any parking tickets and have decided to fight ticket..at least if anything they may lower the ticket and apply court cost and still come out less then the $250 ticket. I HOPE.. I am in Tampa Fl

ah.... You deliberately and knowingly park in the handicap space and want to fight the ticket? On what grounds?
IMHO instead of just a ticket they should have towed you -- $150 tow fee, $75/day storage fee with a three day minimum. $600 plus to get your car back.
Although he was kidding about the "20% added exasperation fee", if you take this to court the Judge can legally hit you with just about any fine he feels like.

If you can show evidence that the apartment complex does have a shortage of parking spots and the number of people that have been getting parking tickets, then the judge may rule in your favor. You may also try to get the apartment complex management to remove the handicap parking if there isn't a need for it.

the reason the handicap spot gets the extra space is for people who may have wheelchairs. I Myself am entitled to handicap plates, but don't have them because I feel I am mobile enough. I feel it is a show of disrespect by using even a part of a handicapped space. Pay the ticket and don't again do it.

If your car was only 1/4 in the area, then you should only have to pay 1/4 of the fine... NOT!
Next time, park your car where it belongs and leave the whole handicapped space for someone who really needs it!

You CANNOT intrude on a Handicapped spot without a permit

Handicaps need more space.

You should have parked completely in the grass. That striped area is for vans with wheelchair lifts to operate properly. Yes, you should be fined. And yes, I am biased, because I utilize those blue spots.

By your own admition you were parked partially inside the handicapped box. Either you were or were not breaking the law. And by using part of the handicapped box you were breaking the law.
Suck it up and pay the fine.

I think the fine is too excessive. A mistake shouldn't result in 1/4 of the monthly earnings of a person. My caretaker got one in LA (she has a sticker but didn't use it that day because my mother wasn't with her. The fine is 396. Half a month's wages. it's too excessive. The punishment is way beyond the crime.
