A cop lied to me! And possible jail time because of it!?

Okay I was in a car accident a few months ago. it involved me in my friends car and a truck with 4 guys in it (2 were riding in the box)

here is the whole story:

Was driving down the highway and had a truck going slow infront of us. we thought we saw something move in the box, so we turned the highbeams on to see two guys mooning us from the box. they then threw a beer bottle at the car(missed). So we passed to get away from them.

while passing I tossed a half can of coke at the guys in the box and apparently missed.

Then the guys are chasing us and we speed off (3.5 maxima vs 5.0 f150) After we cant see their headlights we slowed back down to the speed limit. They caught up to us with their lights off, then proceeded to flash their highbeams at us and even bumped the back of the car.

They pulled out to come along side us and I tossed a glass pop bottle out. hitting their grille. ( saw it hit for sure) They continued to pull beside us and they hit a bump causing there truck to weave into the side of us. We moved over to hit the soft shoulder. regained control for a second then hit a rut in the gravel and it shot us back into the rear wheel of the truck.

We spun out and stopped in the ditch with no injuries. The truck flipped and went into the other ditch. nobody killed. just lots of road rash.

All occupants of the truck were drunk. Cop refused to do a breath test and let them leave.

they told the cop my bottle hit their windshield. And later when i had to give my statement the cop told me that they had evidence that the bottle broke their windshield and caused them to lose control ( there was over a minute from when i threw the bottle to them weaving)

The cop said if I admit to smashing the windshield I'll get charged with mischief, if I dont i'll get criminal negligence. Again he said they had proof the bottle smashed it.

I went for my first court appearance today and find out he LIED. I admitted the bottle smashed it out of fear of the greater charge he was hanging over my head. Not out of guilt. But I found out, they didnt recover the bottle, and the windshield was totally smashed from the roll over,

I'm not really sure how to proceed now. Yes i threw the bottle. NO it did not cause the accident. Cop just scared me into saying it did, and that if i say what they want. I'll get off easy. Now I'm facing possible jail time!

This happened in southern ontario.

Update:

Yeah it wasnt smart but saying i could have killed people is kind of a stretch.

I think them chasing us after we passed and bumping the back off the car was a little more dangerous than a bottle to the grille.

My question had more to do with the threats from the cop and false promise about the lesser charge that did not happen. is the not coercion?

    Cops can, and often do, lie in order to get incriminating statements from suspects. It's legal. You screwed up. This is why you should get a lawyer before talking to the police. Your lawyer will tell you to shut up, don't say anything. Part of the Miranda warning is "anything you say can and will be used against you in a court of law."

    I find it hard to believe this cop would let these guys go if they were drunk, and why didn't they get a citation of some sort?

    did you get the license no. of the truck? Anyway you did wrong too, so now you have to face the charges. You should have gotten the license no. of the truck and then got off the road and called the cops and reported it. Lucky no one was killed or badly hurt or you could really be in hot water, lawsuits etc..

    I can understand you're pissed off that a cop lied, but at this point it's better just to pay the fines and walk away from this. Hope you have learned something from this.

    So what do you expect people to say? Dont trust cops, thats the moral of the story. Something similar happened to me. I grabbed my drivers license off a security guards clipboard and he lied and said I hit him. I fought it in court and my own public defender told me that I might as well plead guilty to assault because grabbing it from his clipboard is considered assault since his clipboard is his personal effects and that if I didn't plead guilty I might get some considerable jail time. So I plead guilty and then find out that its not assault and she only did that because she had like 20 other cases to deal with that day and wanted to get rid of me quick after I fought it in court for so long. People lie, what do you expect? I was working at Google then, I can't even get a dishwashing job now. Life sucks. I should have got a regular lawyer, thats the most important thing you can do. Don't be cheap and assume it will be an easy case to win, get a real lawyer.

    It's not about what the kid here did that was wrong, his wrong doesn't make it ok for a cop to also commit a wrong. Legally, cops can lie their *sses off. Which sucks. Better hire a good lawyer, and in the future NEVER speak to leos without an attorney present. They are NOT your friends, they are NOT going to give you points for being honest. Say NOTHING except "I'd like my lawyer to be present before I answer any questions". LAWYER UP.

  • So in other words, you acted like a complete moron, could have killed any number of people, lied to the police/courts, and now you want help.....

    How about next time, you act like a sane person from the start and avoid all of this.

    Start telling the truth...that's my advice. I'm sure what you just told us isn't accurate, so figure out what actually happened, and start telling that version.

    Otherwise your hole is going to keep getting bigger.

    Don't throw objects at vehicles. Ever.

    Never trust a cop. Ever.

    Never speak to a cop w\o an attorney present. Ever.

    You have dug yourself into a hole so deep, it's doubtful an attorney can get you out.

    something is achieveable... I had a chum jailed in one day for being under the effect of alcohol. feels like the offense could desire to be distinctly undesirable... so specific. "talking **** to a cop" is distinctly undesirable. under the effect of alcohol gets the guy in detention center on my own. i desire that express individual has a competent lawyer.

    So basically you got mooned and instead of just getting aplate number and calling the cops after the bottle was thrown, roadrage took over. Sorry pal, no sorrow or pity here. You did the crime, now do the time.
