Can anyone would actually read this story tell me the "miscarriage of justice" is, as the defense claims?

    From your source:

"Gallo had a previous DUI conviction, had specific knowledge of the dangers of drinking and driving from his own experience, and had signed a court form from the earlier case saying he understood he could be charged with murder if he drove drunk again and killed someone."

He knew exactly what he was doing and the consequences. No miscarriage of justice here.

Yes it was a miscarriage of justice. The jerk should have gotten a murder one rap.

He got caught once before, he stated that he knew the score yet he still went out and drank and drove.

I understand the fact that alcoholism is a disease (so they say) but buy your alcohol and get toasted at home or stay where you are at.

Alcohol alters the brain and for anyone over the age of 21 it is legal to consume.

Driving while intoxicated on a brain altering drug is illegal.

    Go figure.

It should have been a manslaughter conviction, not murder.

    Just my opinion.

Nope. He's getting what he deserves. If you can't do the time. don't do the crime.
