diversion programs california MIP?
Hi, I recently got an MIP in California. I am 18 years old and this is my first offense. I am wondering my chances of getting into a divisional program or whatever to get this off of my record and not be considered convicted. I am a generally good kid. I have been working for two years and I am currently going to college. I did very well in high school with advanced classes, etc. I do not know if any of this will help. I know they are not going to see it as "this is your first offense, take it easy" but more of "You're only 18 and you're already getting in trouble". I really desperately want to get into a diversion program and will do whatever it takes to get it done. What do I need to do to help my chances? What should I let them know? Please help.

This can be filed as a misdemeanor or an infraction. If it is filed as a misdemeanor you will be entitled to appointed counsel if you cannot afford an attorney. You should take advantage of that. Your biggest problem is not having this on your record, it is that a conviction of this offense for anybody under 21 carries a 1 year drivers license suspension. Because of that many courts do have diversionary programs. The best way to help your chances is to keep doing what you are doing--go to school, get good grades, keep out of trouble, make all your court appearances, don't be late, and dress like you were going to church, not a baseball game.
