The seller took the fridge and it was checked on the contract?

I did a walk through with my agent today. The seller took all of her personal stuff, but she also took the refrigerator, which was checked on the contract. I haven't signed with escrow yet, but we really want the house. Can I take the seller to court afterwards or should I just eat the costs of a new one?

    if on the contract it says the fridge is included, you should get the fridge. If they took it, you can ask them first if they want to lower the cost of the house of few hundred dollars (depends how nice the fridge is). If they won't budge, then you have to really think about it. Is it worth the time and money to fight this in court or should you just get a brand new fridge of your choice?

    I would mention it to the owner and see what she says and if it looks like she is not going to budge, I'd just let it slide and get a new one.

    Neither. You are entitled to a fridge and your realtor should make sure that you get one from the seller. That can be one that the seller puts in the house. or the price of one to replace what was taken. Just keep in mind that unless the contract states refrigerator XX, model no#xyz, the seller is not obligated to put back the same fridge, just a fridge. If you really want the house, and you cannot settle on the fridge issue, I would eat the cost, but if it is the contract, it seems like the seller had to give you one.

    This is the exact reason why you do a walk thru prior to closing in case the seller does just that.

    I would ask the seller to write you a check for the refrigerator they took. If you ask for a credit on the closing documents the closing will not happen until a new Hud Statement is redone and that will take a while so if you want to close on time state that the seller needs to pay you for the fridge that was included in the house or postpone the closing until the HUD statement is redone to show acredit to the buyer for the fridge.

    No at the closing the seller writes you a check for a new fridge. Cut out some ads of what you want and bring them to the closing.

    Sad to say but seller's pull this crap all the time.

    you don't need to go to court, but your realtor needs to make sure that the seller provides you with a concession at closing equal to the value of a new fridge, which you now have to buy. a friend of mine noticed a pan rack was missing at her walk thru, and she had to fight to get a few hundred dollars from the seller at closing but she really wanted that rack! if you borrowed X amt of $$$ for the house because it had certain amenities, all those amenities should be present at closing or else the seller has to pay you.
