Hate speech that is just hateful should be allowed just to bring it to the surface, so we can destroy it. Freedom of speech doesn't give you freedom from responsibility from what you said - if you're a racist ********, I'm going to call you that, and if you cry, **** you.
Hate speech expressly advocating violence or death to the victim of hate should be treated as such as well - an incitement to violence. If you order the death of someone, you're just as guilty as if you pulled the trigger.

Since the original intent of Freedom of Speech in the 1st Amendment was the protection of political speech and not social speech, hate speech was never intended for protection. So, no, it shouldn't be granted protection. For some reason, human behavior that used to be regulated by social conventions (rules) is moving into the legal and political spheres.

It is a requirement for free speech. How does one define hate speech.??? Is it anything I do not want to hear. Is preaching about Jesus hate speech to those who dislike that statement? ? Is declaring homosexuality hate speech to those who dislike that statement? What draws the line on ok speak and hate speak.

I am for total free speech even when I do not agree with it......
(footnote) Speech that incites riots and / or direct harm to others must be curbed for safety sake ....but other than that narrow caviot I want totally free speech

I think we need to think terms of appropriate speech . Is Hate appropriate in a country where we supposedly are "United"? I know we don't always like our neighbor, but to HATE them? Most of us can be civil , say hi, and or avoid a neighbor we don't like.
But should we go outside in the street banging a drum, standing on a soapbox with a microphone, yelling to everyone about how bad that neighbor is and our grievances against them? And that all our city should feel just like we do? And we should vote to kick Mrs. Crabapple off our street? And should I then have people on our street over for coffee and strudel and have a hate fest talking about our neighbor?
Its "OK" to have a hate fest, in theory , but for civil structure, its not a good idea . It would be inappropriate to jump on a soapbox and start hating on my neighbor, and asking others to do the same.

Free speech is always right even if some think it is hate that is only a buzz word for people who oppose your views they cannot make a intelligent argument so they just call it hate.

who is going to define what hate speech is?
I think it's hateful to call somebody a racist simply because he/she says something that offends you. Using buzz words like that just means you don't have to honestly address issues.
If I am judging hate speech, then half the answers to this question would be banned.
