The snow bank was frozen and the car went over 10 feet up into it. His back wheels stopped at the bottom of the bank. The angle of the bank was approximately 45 degrees. My wife was in an accident and the other driver claims to have hit ice then her and then slid into the snow bank. the posted speed limit is 25 MPH. The police report does not state who is at fault or the other drivers estimated speed or other thing the driver said, because the driver that hit her has a brother on the police force in the town it happened in.

Sorry, the question should read How fast was he going. He hit my wife, then ice. We are trying to find out how fast he was going. The police report was missing a lot of details.

It sounds like the driver who hit ice, then slid into her should be liable.....the bank would have no impact on liability - unless she broke a law stated by the police......
