Technically no a person is not sober at 0.08BAC. I can feel the difference after one drink and I have no idea if my BAC is 0.05 or 0.08 at that time. I still have a rational functioning mind and can act just as a sober person is expected to act. Let us just look at it from two points of view the legal, and the physical{social}.

In my opinion sobriety has nothing at all to do with BAC.

Sobriety is, to my mind, the level at which alcohol notieably affects your behaviour & reactions, and this is different for everyone.

The BAC limits set for driving vary all over the world, and are all based on different theories on what is drunk, and are all FLAWED.

Take 2 people with exactly the same alcohol tolerance, one weighting 100lbs, the other 200lbs.

They would both show the effects of the alcohol at the same time, however the BAC in the heavier would be lower due to having more blood in his (or her) body.

While the sobriety tests I keep seeing on American TV programs, I'm English, are completely subjective (walking a line, standing on one leg, touching your nose etc aren't exactly scientific), they are in my opinion a better measure of if someone is capable of driving than an arbitrary BAC level.

Unfortunately the law makers have to have something they can scientifically measure to cover their own backsides in the case of accidents, so BAC levels are going nowhere until something better comes alone, and the skinny ones in the population will just have to drink less than their fat friends.

.08 is legally under the influence of alcohol. In Michigan , one gets a ticket for 'under the influence' which means you have had some alcohol and it has impaired your driving somehow. The 2nd ticket is for UBAL.....'unlawful blood alcohol level' ( of .o8 or higher.) If ones blood alcohol is .25 or higher, penalties are very severe. In Michigan, the fines and costs run at least $7,000.

I have arrested hundreds of drunk drivers. Some have had very little to drink and seldom drink and it really messes up their driving skills. I would say 95% of my fatal accidents, there was alcohol involved with the at- fault driver. That's 15 years in jail.

everyone responds differently. if you have a high tolerance you may be able to pass a field sobriety test at .08, but you would fail a breathalyzer... and being buzzed is still considered legally drunk

and some people might fail a sobriety test under .06. everyone is different

If your blood alcohol is that high and you get pulled over and tested you will get a DUI even if you pass all the sobriety tests. It's a law and they have to use numbers to determine whether you are culpable or not.
