neighbour building an extension above garage on party wall?

My neighbour has had planning permission approved to build a single storey extension above an existing garage. This garage has a shared party wall with my own garage. The neighbour wants to erect scaffolding on my garage roof to allow the build to progress. I do not really want to allow this as I feel damage could be caused to my roof (felt tears etc) by having scaffold installed and builders scrambling about on my roof. Can I stop them from working on my property ? Is there any law that covers this ?

Update:

Yes, they do have planning permission and yes I did raise this issue amongst others before it was approved. I am yet to be served notice under the party wall act though so they cannot actually commence with the work until they have done this.

Seeing previous maintenance carried out on my neighbours property by the builder they use has left me with very little confidence of seeing a job well done. That is why I am concerned about them using my property.

Update 2:

Apparently, the buildings were originally built with a double skinned wall. I know this from the original builder who constructed the properties. As for builders trestles - will they need to use my garage roof with these ?

I have seen all plans / applications / decisions. All is legit apart from not being served notice under the party wall act

    i guess it all depends on what kind of finish you want to be looking at!!

    you have every right to stop access from your side of the wall, but then the builders will have to build the extension from the inside, and as a result the pointing you'll be looking at will be horrible!

    Also, any reputable scaffold company will have insurance etc, and will certainly repair any damage to your roof once they finished.

    Also, for the sake of neighbour relations wouldnt it just be easier to not refuse? What goes around comes around etc?

    If your neighbour is building on a true party wall you are entitled to ask for a Party Wall Agreement to be drawn up. You can appoint a Party Wall Surveyor and the neighbour has to pay all costs. Your neighbour should have served a Party Wall Notice to you informing you of their intention to carry out the work. Check out the web site for the Royal Institute of Chartered Surveyors.

    im a builder in uk ..no they cannot work on your side without permission ..and i doubt if they have planning as they all ways inform the next door neighbour about any works ...all so the neighbour has to give you notice under the party wall act ..and you don't need scaffold as you are halfway up to start ..just need builders trestles ...now the real crunch ..the wall between the garages is normally singe skin ..either he puts in large steels to carry upstairs brickwork ..or he will need to build another skin for inside brickwork ...all works to be under building control supervision ..ring local planners ..give them next doors address ..they should ..if they have it..be able to give you a number and you can look up these drawings on the net ...or go to planning office....add have now read some added info ...the outside walls may be 9"..but i doubt if the party wall is ..if its a single skin then half the wall is yours ..he cannot build on this ...i have had the same problem myself in past ..yes they would need your roof for the trestles ..and your permission

    Are you sure they have planning permission to do this? Part of the planning process involves sending letters or visiting neighbours especially where the work will involve access to their property and asking for any objections before the permission is granted. If this hasn't happened then contact the planning dept of your council to check that they have planning persmission. You don't have to allow them access to your property and can stop them from climbing on your roof.

    Yes of course you can stop it, it is your roof. Just tell them no. If they insist call the Police for trespass.
