Any1 Else had this experience and any1 know if i have a negligence/misconduct case?

hi there, I am wondering if any1 knows if i have enough to take out a negligence case against a hospital Maternity Unit.

The basics;

I was not told I had severe pre-eclampsia and was left to go overdue

I was not told i had Strep B until at 38/39 weeks i asked what i big yellow sticker meant on my file (at which point i was all ready for a home birth and my midwife from doctors had delivered my home birthing kit).

Doctors/midwife's failed to inform me of what my sons condition meant until he was 5 days old (high Billy Ruben Levels) and i had been attending hospital for 3 days for his daily blood test after discharging us due to a nurse saying he only had a little jaundice and it would only mean he may sleep through feeds and be over tired.

Midwifes failed to help me have any contact with my son until i could manage myself the day after he was born.

I have only just found out through a new hospital which i attend due to post birth problems that i had suffered from pre eclampsia, my son is now 18 months old. Could i have a case against them for negligence or misconduct. OR is it just a case of writting a normal compaints letter regarding the way i was tret?? SERIOUS ANSWERS ONLY FROM PEOPLE WHO KNOW!! I thank you in advance for your help.

    Pre eclampsia often resides after giving birth - if they can show that your blood pressure was monitored and recorded according to guidelines (specific to the hospital) then whilst there is much about all this that you have every right to be upset about and a lot that does not reflect a strong duty of care my feeling is that as no one was injured/suffered as a result that it might be seen as more a complaint then a genuine case of misconduct.

    Well,In my personal opinion...I disagree with the other answers!.I am almost a qualified Midwife and I understand the possible complications of Pre-eclampsia alone,not to mention your other problems and you definately should have been told about these things.I would therefore strongly recommend that you take up a strong 'complaint',Though it was indeed 'Medical negligence' that you were not informed of these health problems..It is only classed as a 'legal' negligence case if their had been any physical repercussions as a result of the negligence.

    If for any reason your Pre-eclampsia had worsened during your pregnancy you could have experienced any of the following...

    1.Lack of blood flow to the placenta. Preeclampsia affects the arteries carrying blood to the placenta. If the placenta doesn't get enough blood, your baby may receive less oxygen and fewer nutrients. This can lead to slow growth, low birth weight, preterm birth and breathing difficulties for your baby.

    2.Placental abruption. Preeclampsia increases your risk of placental abruption, in which the placenta separates from the inner wall of your uterus before delivery. Severe abruption can cause heavy bleeding and damage to the placenta, which can be life-threatening for both you and your baby.

    3.HELLP syndrome. HELLP — which stands for hemolysis (the destruction of red blood cells), elevated liver enzymes and low platelet count — syndrome can rapidly become life-threatening for both you and your baby. Symptoms of HELLP syndrome include nausea and vomiting, headache, and upper right abdominal pain. HELLP syndrome is particularly dangerous because it can occur before signs or symptoms of preeclampsia appear.

    4.Eclampsia. When preeclampsia isn't controlled, eclampsia — which is essentially preeclampsia plus seizures — can develop. Symptoms of eclampsia include upper right abdominal pain, severe headache, vision problems and change in mental status, such as decreased alertness. Eclampsia can permanently damage your vital organs, including your brain, liver and kidneys. Left untreated, eclampsia can cause coma, brain damage and death for both you and your baby.

    ..and these are just 4 of the main possible complications that could have happened to you & your baby,,and they did not feel it worthy enough to inform you!????.

    As for Strep B in pregnancy...

    Though it is not guaranteed that your baby would contract it from you,the complications are grim...

    GBS can cause bladder infections and uterine infections for the mother. In serious cases GBS can cause meningitis, sepsis, pneumonia or result in stillbirth of the newborn!.

    If it was me personally,I would go straight to the senior management of the hospital and put your negligence complaint to them,explaining how distressing they made your time in hospital etc and that you are taking matters further unless they can look to a justified solution.

    If you are not happy with their response,and let's face it,,a simple 'sorry' does NOT count considering the worry you must have gone through,,then you should either take your case to a solicitor or approach the highest authority of the hospital regulators etc.

    My best advice to you..Don't be silenced..You and your baby deserved far better,more informed diagnosis and treatment in what should be a magical time of pregnancy!

    i dont think it counts as misconduct/neglect........a failure to communicate, otherwise no, as u were treated for the mentioned issues.
