What is the legality of pie throwing?

So, after Murdoch the Clown took a pie to the face, it got me thinking is this legal?

Is it legal to throw a pie at someone, assuming that the pie is not harmful (made with shaving cream, or whipped cream)? Is it considered assault of some kind, or is it good clean political out rage?

    Technically it's 'assault', maybe even 'assault and battery'. Especially on an 80 year old man, even if he -is- the spawn of the devil.

    But a lot of people have used pie-throwing to register their dissatisfaction with 'public figures'. I remember it happening to Bill Gates also. Usually the 'victim' won't press charges because it makes him look mean and vindictive, I mean more mean and vindictive than he already looks. So I'm guessing the charge is reduced to something really minor like disturbing the peace or trespassing.

    The guy who threw the pie probably got roughed up by the guards a lot worse than Murdoch did by the pie.

    There have been arrests over the years in such incidents. Charges could range from assault to mischief. Often they are brought about by the Hotel or owner of the establishment for trespass.
