Is it legal to advertise a vehicle for sale that you don't own but you left a deposit on?

Not actually sell it before it's picked up....ADVERTISE it for sale before it's picked up.

You can advertise it, but how are you going to sell it? Or even let them test drive it!
You would actually need the title to be able to sell it and the party you left the deposit with would have that. Even if you did sell it, you would have to pay them, transfer the title to you, then once you actually got the new title you would transfer to the buying party.
Unless you moved into a roll of brokering the sale for the first party so they transfer direct to the final buyer, but you run the risk of getting cut out of the deal.
