On my tax return, can I claim my husband is disabled, or just unemployed.?

His Dr. told him he is permenatly disabled, but he was turned down for Social Security disability. If SSD says he's not disabled can I still "select" disabled on the tax return?

Update:

He does not receive any disability payments.

    you are filing a joint tax return and if he has a statement from a doctor that he is disabled, yes you can mark the disabled box

    the doctor must provide a written statement, not merely a verbal statement of his disability

    You and your husband will file a Married Filing Joint "MFJ" return. There is not a place to show he is disabled.

    You will use his SSN and name first on the return and yours as second (spouse).

    Both of you will sign the return he signs first and you second.
