The last that I heard, the execution has been put on hold..But as to whether or not the execution should go forward,..I have a sneaking suspicion, that T.D. was, in fact, one of the two, seen beating up the homeless guy,..And, since most of the stuff on the web, is claiming that he is "innocent", I take notice that there is no mention, of whether or not he has a criminal record, because, if he had no record, then those looking to set aside the death penalty, would be harping on that issue, so I "suspect" that he has a record. And, "IF" he has a record, then I am inclined to believe him "guilty". But, be that as it may, there is the matter of some witnesses recanting their testimony. So, all in all, I suspect that he was one of the guys, beating up the homeless guy, & while maybe he did not actually shoot the victim, I "suspect" that he was involved,..So, my inclinations might be, that the DA should offer T.D. a deal,..In that if T.D. would "rat out" the other guy,.then the death sentence could be comuted to "life, without parole", So, all in all, I suspect that he is, at least, partially responsible, but I also believe that the loose ends need to be tied up,. Even then, I do have some problems with the death penalty, being imposed, when the conviction is based solely on eye witness testimony,..So if I were the judge, I would commute the sentece to "life without parole", even though I suspect that he is guilty,..But, then again, "IF" the witnesses identified T.D. as one of those beating the homeless Guy, I might, then find him guilty, of the shooting, even though he may not have been the triggerman,... .

I was not privy to the police investigation, the review by the DA, and did not sit on the jury
So I do not have all the facts in the case
What I know is that the jury found him guilty
The Judge agreed with the jury and sentenced him to death
I feel comfortable in believing those people did the best job they could in weighing the facts
Then 20 years of appeals, hearings and reviews turned up no new evidence
So I have no reason to say that he was not guilty
And I therefore support the completion of the verdict
Now he can really be judged
After all, all the execution did was arrange the meeting with his ultimate judge

When Officer MacPhail approached the group of men he tried to stop beating a homeless man he did so in the knowledge that Georgia would execute any person who murdered a Police Officer in such circumstances. The person who murdered Officer MacPhail did so knowing the penalty for killing an Officer was death. The trust Officer MacPhail had in his country supporting him has not been betrayed by the Authorities in Georgia.
