Can my employer make me work longer than scheduled without asking?
I routinely get a shift at my place of work that starts at 4am and typically ends at either 8am, 11am, or 12pm. This shift involves unloading a large transport truck of supplies for the store. There are 2 stores in my area and 1 of the 2 people working this shift needs to drive over to the 2nd store and unload all of their stuff as well.
However, being the person to unload the 2nd store usually means you are staying at least until 12pm, sometimes up to an hour later. This week my schedule read that I am working 4am-11am, and my manager said I was going to be doing both stores.
My question is, when 11am rolls around can I just go home, or do I have to finish the entire 2nd truck? There was no agreement between me and my manager/employer that I would be staying as long as it takes to get it done, and I never consented to anything of that nature. Can they just make me stay even though I am not scheduled for another hour?
I live in Ontario Canada btw, if that makes any difference.

In the us, no more than 8 hour days, 40 hour weeks, without agreement to overtime or unless salaried or piece work. If you are hurly, and he wants you to exceed the 8 hours or 40 hours, you can say no, he can't fire you over it, work done or no. He can "invent "another reason, though.
4am to 12 pm is only 8 hours. Times five days is not exceeding legal limit in US.
If he does, get your time cards and show you were over the legal lmit and "forced" to do O/T .

Yes, basically you have to stay until the work is done. Like in call centers, the people may be scheduled off at midnight but end up staying until all the calls in queue are finished.
Source(s): Please ignore the guy that said that in the US you only work 8 hours a day. That is ridiculous. There are plenty of jobs where people work 10 or 12 hour shifts. Not just nurses, etc. It's very common and you don't need a special contract for it. - LizLv 610 years ago
Can the employer "make" you stay? Of course not. Can they fire you if you don't stay after they tell you your shift isn't over until the work is done? Sure.

No, you do not have to stay. But the employer does not have to keep you as an employee either. Quit whining and just do the job. You should be grateful that you are earning money.
