If my ISP provides a minimum speed for my broadband and i always clock it way below, can i take action?

on my ISP (internet service provider)'s website, it gives me a minimum broadband speed, based on my home phone number. whenever i check my speed i always clock it at way below (it says minimum speed 750 kbps but i usually get around 50kbps on a speed checker or about 12kbps from my browser (google chrome, it tells you your connection speed) when im downloading something.(that is the only time i can check via my browser). my question is, is there anything i can do? i know about computers as well so i am 100% on the fact it is kpbs.

What it says about my speed on the ISP's website:

Min: 750 Kbps, Max: 2.5 Mbps

Estimated DownSpeed 1 Mbps

My provider is Eclipse.

EA and google are a couple of the people i have downloaded from, i really doubt they have slow upload speed.

i am using the new laptop i got for christmas, and its a fairly good one too so i doubt its that.

    It's not entirely up to them what speed you get. You could be downloading from someone who has a slow upload speed.

    Never known an ISP give a minimum speed. They only give a possible maximum with no guarantee that you can attain that speed at your location. Check with your provider

    You can't sue, but you can complain. BUT, don't confuse actual download speed, which is controlled by the upload speed of the site you are downloading from, with capacity speed. You may have the rated capacity speed.
