Atheists-Are you worried? Muslim judge throws out case against muslim who choked atheist.?

World Net Daily-A Muslim judge in Pennsylvania – who scolded a local atheist for offending Islam, called him a doofus and accused him of “using the First Amendment” to madden Muslims – dismissed harassment charges against the Muslim defendant who purportedly choked the atheist during a Halloween parade.

District Judge Mark Martin brought a Quran to court and told the alleged victim, American Atheists’ Pennsylvania State Director Ernest Perce V, “I think you misinterpreted a couple of things. So before you start mocking somebody else’s religion, you might want to find out a little more about it. It kind of makes you look like a doofus".

The judge added, “I think our forefathers intended to use the First Amendment so we can speak with our mind, not to p— off other people and cultures – which is what you did.”

Perce had worn a “zombie Muhammad” costume and proclaimed that he was the Prophet Muhammad risen from the dead at the Oct, 11, 2011, event in Mechanicsburg, Pa. A “zombie pope” was also featured in the parade that night.

Now the Scranton Atheism Examiner reports that Perce could be arrested for posting audio of the judge scolding him for mocking Muhammad. According to report, the Muslim judge has threatened to hold him in contempt of court for releasing the recording. Perce has claimed he was given permission to post the audio.

The Examiner reports that Perce said he posted the audio because the judge treated him unfairly and showed preferential treatment for the Muslim defendant.

According to reports, the atheists were marching when Talaag Elbayomy, a Muslim, stormed out of the crowd and assaulted Perce, grabbing a sign around his neck and pulling until the strings choked him.

The men caught the attention of a nearby police officer.

Mechanicsburg Police Officer Bryan Curtis told Pennsylvania’s WHTM-TV, “Mr. Perce has the right to do what he did that evening, and the defendant in this case was wrong in what he did in confronting him.”

He added, “I believe that I brought a case that showed proof beyond a reasonable doubt, and the case was dismissed, and I was disappointed.”

Elbayomy – who said he believed it was illegal to mock Muhammad – was charged with harassment. He denied touching Perce at trial, but Officer Curtis said Elbayomy admitted grabbing Perce’s sign and beard the night of the incident.

    Anyone who recognizes religious freedom should be worried.

    However, as recent events have shown, atheists have only a flimsy commitment to religious freedom. Some of your respondents here actually side with the assailant, claiming that any religion deserves respect. In this case, the cult that justifies beating a protestor also went after Danish cartoonists, killed people this week over burning a Quran, and used airliners as human bombs to kill 3000 people in New York and Washington.

    By comparison, Fred Phelps and his family have yet to kill anyone.

    In addition, atheists have displayed indifference or active contempt for Catholic schools, hospitals, and charitable groups who have been ordered to pay for free contraceptives, abortifacients, and sterilization as "health insurance." Freedom of religion apparently does not extend to religious groups.

    But when you think about it, freedom of religion depends on the endowment of the Creator, who the atheists imagine to be a "flying spaghetti monster" or a "leprechaun." Freedoms don't last long in under the assumption of an absurd, accidental universe.

    These things can and are done about Christians all the time, and no one

    says anything at all...why is that?

    No one, obviously to some, should mock ANYONE's religion, but, of

    course they do, and the judge was right to point out this is an ABUSE

    of the amendment, not proper use. So the amendment should be

    changed somewhat.

    But we note that the pope was mocked also and no Christian ran and

    complained about that, did they.

    So then, do Muslims have far greater power in US than Christians?

    Why can they do this to Christians yet not to Muslims?

    Yes, atheists need to stay in Christian countries to practice their

    beliefs, and not go near Muslim countries where they would be

    put to death.

    This is definitely a misapplication of the law, but there is certianly an air of "What did you think would happen?"

    Obviously Perce had the right to peacably assemble and has freedom of speech and thus Elbayomy had no right to attack Perce.

    That being said, the common sense portion must at least come into play. A KKK rally in harlem is going to incite violence, it is just simply human nature. Mocking and deriding a person and there viewpoints is going to draw a violent response. Let me give you an example. If some idiot started publically calling my wife names and insulting her, I consider myself a reasonable man, but I would knock him out. I would also accept the consequences of knocking him out as well.

    Some atheists acting like a bunch of idiots, mocking the religion of others and acting in a generally detestable way, and are actually surprised when they get attacked? Stupid people. Thankfully not all atheists are this stupid, as Andrew aptly demonstrates.

    An assault (or harrassment) charge retried on appeal. I doubt that would occur, sounds too much like double jeopardy to me. I'm sure Perce can sue for compensetory damages in a civil suit, but there is no way that case (if it actually happened) goes to appeal.

    Oh, that's interesting. Usually the Muslims persecute the Jews and Christians only, but of course, anyone who insults their religion will get in trouble with them. They think they own the world. I believe the antichrist will be Muslim. It's good this case is being taken to a higher court though. I sincerely hope the Atheist wins.

    You know,apart from the source,what makes me doubt this story is that the Muslim would have been charged with assault,not harassment,and no judge would have accepted ''he offended my delicate sensibilities'' as a defense for assault.

    I worry whenever someone cites "World Net Daily" as a credible source. Their site is garbage and anyone who takes their word for anything, as if it is the complete story, is not too bright. Have you made any effort to verify anything in their story?

    Religious slurs are not illegal. Not in my country anyway.

    I agree that the guy brought it on himself by insulting the religion to a believers face.

    But the religious guy should not of used violence, and the judge should of known that.

    Do you have a citation from a real paper? World Nut Daily makes up all their articles. I wouldn't believe them if they told me it was raining let alone whatever this rambling crap is supposed to show me.
