What type of company can sponsor an H1-B?

What company can sponsor H1B?

I've been researching online and I cannot get a clear answer and they said that any company can sponsor H1B, but how about the followings?

LLC sole proprietorship

LLC partnership (taxed as partnership)

LLC (taxed as corporation)

Can they all sponsor H1B? or it doesnt matter?Thanks,

Awesome answer. but Im about to register a company and I just want to know if I should do an LLC or an S-corp now since we have concluded that any type of company can sponsor an H1B worker....right? or are there still gaps in my understanding...........

    Any employer can sponsor an H1-B. The reason why small companies usually don't do this is because it's expensive and they can find plenty of people in the U.S. who can do that job. If you know somebody who can custom-tailor a job around your skills, then a very small business can sponsor you.

    What you need to know is, that, in general, the employer has to demonstrate that you have the knowledge, skill, or talent to fill their position, and that they are unable to find a qualified candidate within the United States. In other words, they have to justify bringing an alien to the US to fill their position.

    There is an annual limit on the number of those work visas which are made available. The quota for the next fiscal year usually become available an April 1st. Companies that want to sponsor workers usually flood USCIS with petitions at that time. Traditionally, the available visa slots are allocated within a week or two. An employer can submit a petition after that, but it will be denied because the slots have all been allocated. If the petition is accepted and approved then the visa will usually be approved within a few months. You can't start working until the beginning of the fiscal year your visa is issued for, which is October 1st.

    If there's a job you think you're well qualified for then it wouldn't hurt to contact the company and inquire about being sponsored for a work visa. You should probably contact as many companies as you think you're qualified to work at. April 1st is coming fast...

    Once you marry her and file the proper paperwork, the I-130 immigrant petition, the I-485 adjustment of status form and the work authorization request, then she's free to apply for any job she wishes or none at all, like any other. she would no longer be tied to her H1b employer or to the conditions of the visa. she would no longer be in nonimmigrant status, she'd be in a temporary type of immigrant status until they've made a final decision on your petition and the adjustment form. If she leaves the US without Advance Parole, she wouldn't be able to return without an immigrant visa, but she's under no obligation to leave unless her application is turned down. that's very unlikely if you have a real relationship.

    permanent labor certification issued by the Department of Labor (DOL) allows an employer to hire a foreign worker to work permanently in the United States. In most instances, before the U.S. employer can submit an immigration petition to the Department of Homeland Security's U.S. Citizenship and Immigration Services (USCIS), the employer must obtain a certified labor certification application from the DOL's Employment and Training Administration (ETA). The DOL must certify to the USCIS that there are not sufficient U.S. workers able, willing, qualified and available to accept the job opportunity in the area of intended employment and that employment of the foreign worker will not adversely affect the wages and working conditions of similarly employed U.S. workers.

    To improve the operations of the permanent labor certification program (PERM), ETA published a final regulation on December 27, 2004, implementing a new, re-engineered permanent labor certification program, effective March 28, 2005. This new electronic program has improved services to our various stakeholders.
