Are these grounds for eviction?

My parents are the landlord and in our primary and only residence in New York we rent the second floor apartment to a section 8 tenant. After smelling really bad tunes that cause my two sister and mother to get an asthma attack and coughing fits the fire department was called and the tenants were not home, the fire fighters entered the house and started coughing on the first floor because of the fumes, they consequently knocked down the tenants doors and opened all the windows. When the tenants got back in like 10 minutes, they knocked on our door and said the called the police because they were robbed, my mother explained to then that there were so much chemical smell the fire fighters broke the door in that it will be fixed by that evening, the tenant here up set and pulls my mom out of her apartment and slams her against the wall, she pulled a muscle in her shoulder! Police were called and ny mother went to the hospital the pain, is harassment and violence or physical harm to the landlord cause for eviction? What about the use of so much Ammonia that the firefighters had to knock the door open? Because of the violence my family 's safety is at risk! I need these people out ASAP, how can we get this done?

i understand now that section 8 was not a good choice! thats why the question states "Are these grounds for eviction?"

never again will i rent to section 8, having 3 children in college and a home mortgage---needed the income but never again to section 8 those people are wicked and the laws are so corrupt that the landlord doesn't have as much protection as the tenants! thats ridiculous.

    you still have to give them 30 days to move out, unless you press charges on them?

    This is why my mom rather struggle with her mortgage then to rent out to some crazy section 8 bum.

    I rent many properties.

    Every landlord I know has keys to all their rental properties.

    So I'm not sure WHY a door would need to be busted down. Do you not have keys to your rental property? That's really odd.

    This is why all rental property owners have attorneys. Who can tell them if under these circumstances, they have the legal right to evict the tenant.

    It would be the landlords responsibility to make sure the property was not robbed once THEY had the door knocked down. That would mean watching it, until the door was secured against theft.

    All this could have been avoided if you had a KEY to your property. It should read in your contract that you have the right to inspect the property. (without notice in an emergency)

    You do have a contract don't you.

    If you aren't sure how to be a landlord, you need to find out how. An attorney, and a rental contract is a good place to start. And ALWAYS have keys to your rental property.

    Renting to a section 8 tenant has a ton of drawbacks.

    You need to talk to the DA about criminal charges. Have they made any threats since then? If so you need to get a restraint order. You probably have grounds for an eviction, But that is going to take some time.

    With the ammonia and violence, I would suspect a meth lab.
