Is there a law that requires a person to pay a federal income tax?

Second question, Is there a law that requires a person to file income tax returns?

I am during a little research on this matter and asking these questions here on yahoo is part of that research; so anyone who may know for a FACT that there is or is not a law requiring this please provide the federal law that says such.

Thanks much,

Tony :)

Update:

Dear Rob, I did not say anything about not paying taxes. I named ONE and only ONE tax please read question thoroughly thanks

Update 2:

Dear rick, although many are indeed in prison for just that, there are actually several cases where people have been found not guilty and also released from prison due to the inability of a judge or an irs agent to provide the federal law that states such...

Update 3:

Dear the kid, WHITEY HARRELL vs the government

anymore questions?

Update 4:

Dear StephenW, thank you for your great effort, however, that law is referring to the "income tax" and not the FEDERAL INCOME TAX. There is a difference between the two and it still remains unclear as to there being a law that requires a federal income tax. The federal income tax goes directly to the federal reserve bank which in reality is just as federal as the federal express is. That means that your federal income tax is going in the direct pockets of privately run banks, and not one penny of it is being used for the federal government.

    16th Amendment

In 1913, Wyoming ratified the 16th Amendment, providing the three-quarter majority of states necessary to amend the Constitution. The 16th Amendment gave Congress the authority to enact an income tax. That same year, the first Form 1040 appeared after Congress levied a 1 percent tax on net personal incomes above $3,000 with a 6 percent surtax on incomes of more than $500,000.

In 1918, during World War I, the top rate of the income tax rose to 77 percent to help finance the war effort. It dropped sharply in the post-war years, down to 24 percent in 1929, and rose again during the Depression. During World War II, Congress introduced payroll

Yes there's a law that allows the collection of income tax.

And your comment about people being released from prison because the judge or IRS couldn't provide a law that states such is just plain bunk. If you want to believe the nonsense than some people post on the internet, go ahead, but that doesn't make it true. People have been found not guilty because it hasn't been proven that they deliberately broke the laws. But not what you state.

    Yes and yes.

"are actually several cases where people have been found not guilty and also released from prison due to the inability of a judge or an irs agent to provide the federal law that states such..." - Name one.

Whitey Harrel was found not guilty ONLY of criminal failure to file. He still owed all his taxes. He then WAS found guilty subsequently when he did not pay. Your research should have showed you that. In fact your research should have showed you that he lost SEVERAL suits filed against the IRS. You would also find that his debt increased greatly with all the penalties imposed by the courts for his frivolous suits. His attempt to avoid taxation was, as they say, an EPIC FAIL.

    TRY AGAIN CHUCKLES.

Title 26 - Internal Revenue Code

The people that say that there is no law are call "tax deniers" by the IRS and "tax protesters" by accountants and lawyers. While their theories vary, they all have one thing common. Not one of them as ever been victorious in court and gotten out of paying their taxes.

A few of them (Vernice Kuglin, Tommy Cryer, etc.) have been found not guilty of criminal failure to file and fraud charges by basically claiming that they did not understand the law. HOWEVER, they still had to pay their tax bills plus thousands of dollars in penalties and interest. NO ONE has ever been found not liable for taxes because the IRS could not prove that law exists.

Google "Ed and Elaine Brown". Ed is still screaming "show me the law".......from prison.

it would have to be a plateau tax rate to exclude a group. To pay for what we spend each year...40% or more considering the diminishing returns of raising taxes versus total dollars received by the government. If you want to save the poor of this country taxes you would eliminate the corporate tax and the income tax through repeal of the 16fh amendment and then add a sales tax of 15 to 20% on all primary market purchases.

Why is that people do half-time research and conclude from idiots that they have the answer.

The IRS has hundreds of pages refuting (with case law) every argument that claims you don't have to pay taxes.

Doesn't the reality that most of the people claiming you don't have to pay are either in jail or actually do pay mean something to you?

Your court case references are wrong. The individuals may have been aquited of being ignorant of the law, but they STILL owed the money.

there is much research and debate about this issue and thousands have previously tried to prove it is not so but some of them have spent a good part of the lives in a gov't sponsored, gated community

Yes, there is a law. Inability to find the law does not mean that it does not exist. It just means that it is well-hidden.

The laws are buried deep in "Subtitle F - Procedure and Administration" of the Internal Revenue Code, which makes them hard to find.

I found the laws you requested:

    1. The law that says that, if a person must file a return, then that person also must pay is:

    -CITE-

    26 USC Sec. 6151 01/03/2012 (112-90)

    -EXPCITE-

TITLE 26 - INTERNAL REVENUE CODE

Subtitle F - Procedure and Administration

CHAPTER 62 - TIME AND PLACE FOR PAYING TAX

Subchapter A - Place and Due Date for Payment of Tax

    -HEAD-

Sec. 6151. Time and place for paying tax shown on returns

    -STATUTE-

    (a) General rule

Except as otherwise provided in this subchapter, when a return of

tax is required under this title or regulations, the person

required to make such return shall, without assessment or notice

and demand from the Secretary, pay such tax to the internal revenue

officer with whom the return is filed, and shall pay such tax at

the time and place fixed for filing the return (determined without

regard to any extension of time for filing the return).

    (b) Exceptions

    2. The law that says that, if a person's tax "liability" is not zero, then the person must file is:

    -CITE-

    26 USC PART I - RECORDS, STATEMENTS, AND SPECIAL RETURNS 01/03/2012 (112-90)

    -EXPCITE-

TITLE 26 - INTERNAL REVENUE CODE

Subtitle F - Procedure and Administration

CHAPTER 61 - INFORMATION AND RETURNS

Subchapter A - Returns and Records

PART I - RECORDS, STATEMENTS, AND SPECIAL RETURNS

    -HEAD-

PART I - RECORDS, STATEMENTS, AND SPECIAL RETURNS

    -MISC1-

    Sec.

6001. Notice or regulations requiring records, statements,

    and special returns.

    -End-

    -CITE-

    26 USC Sec. 6001 01/03/2012 (112-90)

Subtitle F - Procedure and Administration

CHAPTER 61 - INFORMATION AND RETURNS

Subchapter A - Returns and Records

PART I - RECORDS, STATEMENTS, AND SPECIAL RETURNS

    -HEAD-

Sec. 6001. Notice or regulations requiring records, statements, and

    special returns

    -STATUTE-

Every person liable for any tax imposed by this title, or for the

collection thereof, shall keep such records, render such

statements, make such returns, and comply with such rules and

regulations as the Secretary may from time to time prescribe.

Whenever in the judgment of the Secretary it is necessary, he may

require any person, by notice served upon such person or by

regulations, to make such returns, render such statements, or keep

such records, as the Secretary deems sufficient to show whether or

not such person is liable for tax under this title. The only

records which an employer shall be required to keep under this

section in connection with charged tips shall be charge receipts,

records necessary to comply with section 6053(c), and copies of

statements furnished by employees under section 6053(a).

    3. The law that says who has a tax liability is too long for to post all of it here. It begins:

The 13th amendment to the constitution allows for taxes. The income tax form is how it is implemented.
