Dog got bit on leash by off leash dog question?
So, my 8 year old Golden Retriever (male unneutered) was going for a walk on his leash. My nice neighbor lets me walk both my dogs on there 6 acres. And at the end of the street our neighbor has 4-5 dogs and has a completely fenced yard with a gate, when that gate is closed no dogs or humans can get in or out. They keep the gate open at all times and there dogs roam free. We have had two incidents with one of there dogs in the last 2 weeks. Last week my 8 month old Aussie/Retriever mix was walking on my nice neighbors property which she has allowed for about 12 years (since we moved here) and my neighbor at the end of the streets Lab/Pit mix has been coming out since there gate has been open. Well my mix was on leash like always and that Lab mix came out of no where and pinned my little 50 pound puppy on his back and started going after his neck. But no real physical damage was done, and after wards they were playing together so I just shrugged it off, just showing dominance cause after all they never had seen each other before.
Well this week, my 8 year old GR was (different dog) on leash again like always, and the Lab pit mix and him aren't normally nice to each other they puff up there chest and I pull my dog away when we normally walk him and he's around and continue walking. But this time the Pit mix got my GR pinned on the ground and BIT my dogs ear ok, lota blood at first. I took pics of it. It seemed to be healing but then today I smelt some real nasty smell and I look at my dogs ear where he got bit and this huge pussy sore/cut was there were he was bit. It's really bad it looks like a K9 tooth from the pit mix when pretty deep into flesh. I don't know why I didn't see it before probably because it was caked in blood.
My QUESTION is what are the laws, will they have to pay for my dog being on leash, there dog running up off leash off there property and onto my neighbors. And then biting my dog and giving him a really bad gash, I'm taking him to the vet tomorrow (as soon as I possibly can). Will I have to pay upfront but then can I take them to court to and try to make them give me the money it cost me?
Brief summary of what has happened in the two weeks: At first my puppy got attacked on leash not on the dog owners property but on another neighbors land, it didn't seem to be hurt no cuts or anything. Then this week (actually 2 days ago) my Golden retriever was attacked at the same place (Not on the dog owners property but my other neighbors) and this time pretty serious damage to my dogs ear. What can I do about it?
I definitely called animal control, they came out but didn't tell me if they did anything. So if they talked to the owners about there dog biting mine I assume they know now but I might call them if I can find there number.
@Bindysdogs, I walk my dogs there because I've walked them there for 12 years without problem, lot of grass and room to walk around.
And if that dog came after me, it wouldn't be walking away. But I would rather not talk about that possibility I love animals.

Firstly any leash laws would not apply as these dogs were on private property.
Secondly why haven't you complained to animal control about this aggressive dog having access to roam outside of it's own property.
Does the owner of the attacking dog even know that her dog injured your dog? If not I doubt she will reimburse your vet fees. If she does know then present her with the bill and ask for reimbursement. If she refuses tell her you intend to report her for allowing her aggressive dog to roam.
To find out where you stand legally on this issue you would need to consult a lawyer who is well versed in animal law.

A couple of points: 1. it happened on the other dog's turf, so he was likely just being territorial and you have no right to complain. 2. I would be more concerned that this other dog will leave his property the next time and attack one of the children playing outside. That needs to be discussed with his owner. 3. all these people on this site always berating people for having their dogs off-leash are driving me nuts. My dog got hurt recently off-leash in the bush and several people had something to say about that. Dogs should be able to run off-leash as much as possible. Especially on your own property or out in the woods. I take my dog with me when I ride my horses, does that mean he should be on a leash? That is rediculous. Provided that dogs are well behaved and not aggressive they shouldn't have to be chained up all the time when the leave their house. And all the laws out there that say you should leash your dogs at all times are only hurting the people that have goods dogs. The people with bad dogs don't usually care about rules anyhow and let their dogs roam and do harm.

Well you should be safe to walk your dog this neighbour needs to control the dogs he has that can't get along. I would speak with the neighbour and ask him to come to the vet and pay the fees as now it is a problem. If he doesn't pay then take him to small claims court you have a very good and fair case. In the future if he wont close his gate and control his one bad dog then again call animal control. It sounds like you live in a rural area so I feel it is fair to be more relaxed with the rules and to work together hopefully you both can agree and go on with life.

Stop taking your dogs to that area. You know those dogs are loose there. It makes no sense to keep risking the dogs fighting. You can take the owners of the dogs who bit your dog to court, but is it worth your time and effort? How much are your vet expenses? That's all you will get back. Some courts have fees that you have to pay up front. Have you tried talking to the people with the aggressive dogs?

I'm not a lawyer, so I have no idea. As a layman, I have two questions. You know the mix could possibly be there, so why are you continuing to put your dogs in jeopardy. Number Two...you should be more concerned on you being attacked by this dog...not your dogs.....

You could probably take them to court, If you let your dog run around in your back yard and that dog ends up in the same yard it has the potential to kill your dog. Dont take any chances, I would, that dog seems like he is trying to kill anything in its way, so be careful and just take them to court over it, most liekly they will get all of their dogs taken away because they let them run around the neighborhood unwatched. Explain what happened to the judge and be careful.
