Can we both claim my children on our taxes?
I am single mother of 5 children. I go to school 6 days a week, full time, 9-4:30pm. My only income is tips and child support. My brother moved in with me at the beginning of 2012 and has paid half of all the bills. The only help I get from the state is food stamps and medical. It is now time to do our taxes. I have always claimed all of my children except last yr, my middle child was claimed by her father. My question is...can my brother claim 2 of my children since he did pay for half of our bills. If so, there can only be one head of household. Can he still file as single?
I called the irs last week. He did a worksheet for me while we were on the phone. It did come out that since he is their uncle and paid at least half the bills then he can claim up to 4 of my children but since I want to file also, could we both claim 2 of my children.
In 2011 I filed and claimed 4 of my children. One child was claimed by her father.

I would think so, since he is supporting them. although, you and your brother should get professional advice from a tax professional, that way you can be sure that everything is filed correctly and you both get your maximum refund!

He should not be claiming your children. You should. If you want to give him your tax money, then you can. He is not the father or mother.

he claims your kids = he will get a visit from IRS.
