Can a listed driver get a rental if they are not the owner of the car?

My sister owns a car but I am a listed driver. I was rear-ended and the other driver accepted full responsibility for the accident.

The insurance does cover a rental car, is my sister (the car owner) the only one that can get the rental. Or can I use the rental (instead of my sister - not in addition). We live in Massachusetts

    The only person covered on a rental is the one who picked the rental up,that person is listed as the driver.
