Is my nephew entitled to military benefits?

My nephew is 12 years old and has asbergers syndrome. When he was 5 years old my sister in law took his father to court for a DNA test. He is the father but in court told the judge that he is willing to pay child support but chooses not to be in the boys life. when he was 8 he was diagnosed with asbergers. She has tried to get help and therapy for him but according to the state of VA she makes too much money-she makes 24 thousand a year before taxes. She applied for SSI but because he is an A B student they said that it was not considered a hinderance. Accademically he is a good student but socially he is very awkward, does not interact with his peers and is obsessed with school busses. He has every symptom and profile of asbergers and it is so sad to see him non interact and close himself off when he is around other children. because his father is retired army, is he entitled to any army medical benefits?

I accompanied her to court last week and she pleaded with The department of Social Security and said "If approved for SSI I don't want the money, don't send the check to me, send it to the program and therapy center-so long as he gets help!" it was so sad seeing her like that. I think everyone was crying.

please no nasty comments. just need advice.

Update:

He might be if the father is retired from the military. She can always contact the VA and ask.

The most important thing is documentation. Make sure he gets copies of all medical paperwork relating to his knee. It might be a good idea to see a civilian doc as well. He also needs to be able to get statements from any of his buddies who may have seen him hurt himself. This will all help out if he wants to claim anything with the VA. He should probably contact a VA rep as soon as he can.

As an ancillary to your question, people with Asperger's (note: "p" not "b") are generally a whole lot less concerned with their situation than are family members. They (we) usually do quite well and are just somewhat differently connected. Although the writers of the series "The Big Bang Theory" said that they were not thinking of Asperger's Syndrome when they invented the Sheldon character (they consider what Sheldon does as being "Sheldon-y") they have pretty much written a text-book Asperger character.

It's Asperger 's, not asbergers, and it's pronounced as*PER*ger's, not AS*per*ger's. She'll have to contact the VA. They're the only ones who can tell her. Make sure she had the paperwork proving who the father is at hand. Best wishes.
