Can I withdraw my plea deal?

I stupidly accepted a plea deal even though I am sure I would have been found innocent in trial. my attorney explained work release as "like community service" and that is one of the main reasons I accepted the plea. Now as I am going to work release I find out it is nothing like community service it is 8 hours a day! My defense attorney said she did not know how long a day was but "didn't think" it was 8. now I am finding out it is 8. Plus I cannot pick where to work like community service nor the hours when to work only the day.

so I think I should be able to retract my plea deal because, thanks to my attorney, I did not fully understand the terms of the contract that i signed.

What should I do?

If I cant withdraw my plea agreement what should I do? I cannot fulfill the terms, I do not have the time for work release.

    You never said why you ended up in this situation in the first place, Thank your lucky stars you never ended up in prison if it was a lockable crime. No point withdrawing your plea knowing the police they would do you for wasting police time. You can't win with them so suck it up. some you win some you lose

    I think you are stuck with the deal because the D.A. entered it in good faith and you were supposed to be represented by a competent attorney.

    I think at best you might have a complaint against your defense attorney. She should have known down to the dime what work release involves from sunrise to sunset. Work release is not complicated.

    Finally, there are plenty of people rotting in jail and prison because they too thought they'd be found not guilty by a jury. I served on a jury all the way to verdict. In my opinion if the jury doesn't hate the defendant or even better kind of likes the defendant or has sympathy for the defendant then that person has as best of a chance that can be had to be found not guilty.

    But, if the jury doesn't like you then you are pretty much done for. So how sympathetic do you think you would have come across at trail because it my opinion that matters the most.

    Actually, it is not only LIKE community service, it IS community service.

    In general, once a plea bargain is accepted by the court, it can't be withdrawn. In the case you describe, you may be able to petition the court to vacate the agreement based on ineffective assistance of counsel. More than likely, that will require hiring a different attorney.

    Most plea deals require you admit the offence and agree to the conditiions of the deal.

    There is nothing to withdraw. If you don't do the agreed plan, you go to jail, which is probably more inconvenient than work release.
