When Intel receives an RMA board they refurbish it, verify its functionality, and then send it out as a replacement board for a different customer.
When you recieved your replacement board it was actually a used board that got refurbished. Likewise your original board was refurbished and then sent to a different customer.
Intel no longer has your original motherboard since they gave it to a different customer. This is why they can not return it to you.

If your original board was working fine why did you send it in? Anyway they wont give you your original board back because if you sent it to them saying its faulty, they have probably already disassembled it and salvaged/recycled what they could or refurbished it. And a 4c difference is nothing to be concerned about, the heatsink might be sitting a little different on whatever part you are talking about with those temps.
